A FIXED HIGH EXPANSION FOAM FIRE-FIGHTING SYSTEM COMPLYING WITH THE PROVISIONS OF THE FIRE SAFETY SYSTEMS CODE; THE QUANTITY OF FOAM CONCENTRATE AVAILABLE SHALL BE SUFFICIENT TO PRODUCE A VOLUME OF FOAM EQUAL TO AT LEAST FIVE TIMES THE VOLUME OF THE LARGEST SPACE ENCLOSED BY STEEL BULKHEADS, AT THE NOMINAL EXPANSION RATIO OR ENOUGH FOR 30 MIN OF FULL OPERATION FOR THE LARGEST PROTECTED SPACE, OR WHICHEVER IS GREATER. THE MINIMUM REQUIRED QUANTITY OF FOAM CONCENTRATE TO PROTECT THE SHIP’S LARGEST PROTECTED SPACE (ENGINE ROOM) IS 916 LITERS. THE SHIP HAS APPROXIMATELY 736 LITERS OF THE MINIMUM REQUIRED CAPACITY. ON 26FEB19, A MONTHLY INSPECTION REQUIRED BY THE SHIP’S SMS MANUAL (FORM SOM-1) WAS CONDUCTED BY THE CREW AND THE ASSOCIATED RECORD SHEET INDICATED THAT THE FOAM SYSTEM WAS “NIL.” THIS INSPECTION INCLUDED VERIFYING THE AMOUNT OF FOAM IN THE SYSTEM. THE FLAG DISPENSATION LETTER (ISSUED ON 06MAR19) WAS REVOKED BY FLAG ADMINISTRATION AFTER THE FLAG STATE INSPECTOR ONBOARD DISCOVERED THAT THE FOAM LEVEL ONBOARD WAS BELOW THE MINIMUM LEVEL REQUIRED.

THE COMPANY AND THE SHIP SHALL COMPLY WITH THE REQUIREMENTS OF THE INTERNATIONAL SAFETY MANAGEMENT CODE. FOR THE PURPOSE OF THIS REGULATION, THE REQUIREMENTS OF THE CODE SHALL BE TREATED AS MANDATORY. IN MEETING THESE REQUIREMENTS, THE COMPANY SHOULD ENSURE THAT THE RECORDS OF THESE ACTIVITIES ARE MAINTAINED. DESPITE MISSING ENTRIES IN THE SHIP’S SMS RECORDS, RECORDS HAVE STILL BEEN SIGNED BY SHIPBOARD MANANGEMENT INDICATING THEY WERE REVIEWED. ADDITIONALLY, DUE TO THE SYSTEM NOT BEING MAINTAINED AS PER SMS SCHEDULE, THE OPERATIONAL CONDITION IMPOSED BY FLAG DISPENSATION LETTER FOR THE FIXED FIRE-FIGHTING (WATER-MIST SYSTEM) IS UNKNOWN.
