The certificate of inspection (COI) issued by an Officer in Charge, Marine Inspection (OCMI), to a vessel required to be inspected under 46 U.S.C. 3301 specifies the minimum complement of officers and crew necessary for the safe operation of the vessel. U.S. regulations apply to U.S. certificated vessels even while outside the jurisdiction of the United States. Vessel discharged a U.S. mariner fulfilling the 2nd mate position and embarked a non-US credentialed mariner with the intent to depart Jacksonville, FL with a foreign second Mate. Submit contracts for all credentialed mariners required by 46 CFR 15.501 who will be on board the vessel prior to departure from Jacksonville so that compliance with 46 CFR 15.720 can be verified.

The company should ensure that each ship is manned with qualified, certificated and medically-fit seafarers in accordance with national and international requirements. Except as otherwise provided, each unlicensed seaman must be a citizen of the United States, a lawfully admitted alien, or a foreign national enrolled in the U.S. Merchant Marine Academy. Vessel embarked foreign national A/B on 08Aug2022 in Japan under the provisions of 46 USC 8103(e) and 46 CFR 15.720 (a). On 01Sep2022 the vessel arrived in U.S. port (Brunswick, GA) and the foreign national was not discharged. The vessel then subsequently completed a voyage from Brunswick, GA to Charleston, SC with a foreign national serving in the capacity of A/B. The provisions of 46 CFR 15.720 (a) do not apply to U.S. flagged vessels on domestic voyages. SOLAS IX/3.1; ISM Code 6.2.1; 46 USC 8301 (b); 46 CFR 15.720 (a).

The engineer on watch observed fuel leaking from the Main Engine number 1 cylinder, aft fuel injector high pressure pipe. Fuel was secured to that cylinder, the bridge was notified, and the Main Engine was stopped. Tugs Helan Moran and Haley Moran pushed the vessel back to Berth 2. At 0400 hrs, the vessel was made fast. At 0424 hrs, the pilot departed the vessel placing the vessel on VTS hold until such time as repairs are completed and certified by Class surveyor. After inspection, it was found that the H.P. fuel pipe had failed causing the leak. The said pipe was replaced with an on board spare. The Main Engine was satisfactorily tested.
