The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with additional requirements which may be established by the company. Due to the deficiencies of a technical and/or operational nature identified below which individually or collectively provides objective evidence or a serious failure, or lack of effectiveness of the ISM code, an external audit shall be conducted by the Flag Administration before vessel will be released from its detention to determine whether vessel is operating in compliance with the ISM code. A copy of the completed external audit shall be provided for USCG review prior to departure from the port of Mobile. 74SOLAS (20) IX/3.1 ISM Code Part A/10.1

PSCO observed compromised clamping devices on multiple watertight doors located on aft forecastle bulkhead and forward house bulkhead. 74 SOLAS (04) II-1/3-1

PSCO observed damaged or absent insulation in multiple locations listed as class A boundaries according to ship’s fire control plan and II-2 Reg 9 table 9.6 in and around the following spaces: cargo space boundary next to the engine room, incinerator room, Suez Canal Berthing and forward CO2 space. 74 SOLAS (20) II-2/14.2.1.1.1

PSCO observed modification to electrical systems, and equipment in the incinerator space without RO or administration approval. Master could not provide any documentation regarding installation or approval of such modification. 74 SOLAS (04) II-1/3-1

Muster and embarkation stations shall be adequately illuminated by lighting supplied from the emergency source of electrical power... PSCO observed both inflatable liferaft embarkation lights were unable to be energized while on ships emergency power. 74 SOLAS (20) III/11.4

The level of knowledge of the subjects listed in column 2 of table A-VI/2-1 shall be sufficient to enable the candidate to launch and take charge of a survival craft or rescue boat in emergency situations. PSCO observed Chief Mate unable to turn off the freefall lifeboat engine. STCW A-VI/2.2

Unless expressly provided otherwise in this regulation, at least two widely separated and ready means of escape shall be provided from all spaces or groups of spaces. PSCO observed the Emergency Generator Room was not provided with an accessible secondary means of escape due to the hatch dogging from the outside preventing egress. 74 SOLAS (09) II-2/13.2.1

PSCO observed multiple electrical installation boxes on the weather deck with damaged gaskets and compromised watertight/weathertight integrity. 74 SOLAS (04) II-1/3-1

The following fire protection systems shall be kept in good order so as to ensure their required performance if a fire occurs: fire detection and fire alarm systems. PSCO observed fire detection system for cargo holds disconnected. 74 SOLAS (09) II-2/14.2.1.1.2

Where a fixed gas fire-extinguishing system is used, openings which may admit air to, or allow gas to escape from, a protected space shall be capable of being closed from outside the protected space. PSCO observed that cargo hold drain lines did not have fire caps readily available. 74 SOLAS (09) II-2/10.4.2

Ventilator openings shall be provided with weathertight closing appliances. PSCO observed multiple ventilation closures unable to be fully closed with closing devices tightened. ICLL 3/19.4

Plans and booklets shall be kept up to date; any alterations thereto shall be recorded as soon as practicable. PSCO observed outdated fire control plan regarding the incinerator room. 74 SOLAS (09) II-2/15.2.4.1

All ships of 500 gross tonnage and upwards shall have... rudder indicators to determine and display rudder angle, readable from the conning positions. PSCO observed both bridge wing rudder angle indicators did not match the rudder angle indicator at the helm. 74 SOLAS (20) V/19.2.5.4

Ships shall be designed, constructed and maintained in compliance with electrical requirements of a class society recognized by the administration. Due to failure while conductions crane operations, agent informed PSCO of #2 crane inoperable.

02106-Structural Conditions-The condition of the ship and its equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons onboard. On 13FEB2021 the vessel lost power and dropped anchor, wedging the anchor between the ground and the ship, causing puctures in the port side #2 and #3 ballast tanks and the centerline pipe tunnel. The vessel is not fit to proceed to sea.-74SOLAS(14)I/11 40abc

15105-Safety Management Systems-The company should establish procedures to ensure that personnel are given proper familiarization with their duties. There are no procedures pertaining to proper valve alignment to ensure main propulsion and electrical power plant have proper fuel supply-74SOLAS(14)IX/3.1 & ISM CODE 6.3 17abc

13101-Propulsion and Auxilary Machinery-The machinery, associated piping systems and fittings shall be of a design and construction adequate for the service for which they are intended. While transitting within the channel, vessel lost main propulsion and the electrical power plant.-74SOLAS(14)II-1/26.1 17abc

10119 - Safety of Navigation - The angular position of the rudder shall be indicated on the navigation bridge. PSCO observed the rudder angle indication on the navigation bridge and steering gear repeater were inaccurate by approximately 12 degrees. Rudder stock indicated 35 degrees port/stbd and navigation bridge and steering room repeaters indicated 23 degrees. 74 SOLAS (2004 Cons Ed) II-1/29.11.1 60ac

11104 - Life Saving Appliances - Cargo ships shall carry at least one rescue boat complying with the requirements of section 5.1 of the Code. Crew was unable to start the rescue boat due to a defective and unreliable gear shifting mechanism that is required to be out of gear in order for the engine to start. Crew eventually was able to start the boat. 74 SOLAS (2014 Cons Ed) III/31.2 17ac

11113 - Life Saving Appliances - All life-saving appliances and arrangements shall comply with the applicable requirements of the Code. Where davit arms are recovered by power, safety devices shall be fitted which will automatically cut off power before the davit arms reach the stops in order to prevent overstressing the falls or davits. PSCO observed rescue boat limit switch to be seized and not stopping retrieval of falls. 74 SOLAS (2014 Cons Ed) III/34 LSA Code 6.1.2.7 17ac

11102 - Life Saving Appliances - All life-saving appliances and arrangements shall comply with the applicable requirements of the Code. The normal equipment of every lifeboat shall consist of anti-sea sickness medicine sufficient for at least 48 h and one seasickness bag for each person. Crew could not provide anti-sea sickness medicine. Pills were later discovered in the Master's cabin. 74 SOLAS (2014 Cons Ed) III/34 LSA Code 4.4.8.21 10c

06108 - Cargo Operations Including Equipment - The carriage of solid bulk cargoes other than grain shall be in compliance with the relevant provisions of the IMSBC Code. Cargo information shall be confirmed in writing and by appropriate shipping documents prior to loading cargo. Vessel could not provide any shipping documents or declarations that provide cargo information as required by the IMSBC Code Section 4. Vessel retrieved correct information prior to conclusion of exam. 74 SOLAS (2014 Cons Ed) VI/1-2 IMSBC Code 4.2.2.1 10c

THE CONDITION OF THE SHIP AND ITS EQUIPMENT SHALL BE MAINTAINED TO CONFORM WITH THE PROVISIONS OF THE PRESENT REGULATIONS. PSC OFFICER OBSERVED MULTIPLE HULL PATHCES ON THE FREEFALL LIFEBOAT.
