Oil filtering equipment referred to in paragraph 2 of regulation I/14 shall comply with paragraph 6 of regulation I/14. In addition, it shall be provided with alarm arrangements to indicate when the level cannot be maintained. The system shall also be provided with arrangements to ensure that any discharge of oily mixtures is automatically stopped when oil content of the effluent exceeds 15ppm. PSCO identified a machined piece of metal, welded to the limit switch actuator/valve handle of the oil content meter prohibiting the installed measuring cell from accurately analyzing effluent prior to being discharged overboard. MARPOL 2017 Annex I/14.7

The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations. PSCO observed ship SMS document “FIM CH.C-04 Annex 1 Prevention of Pollution by Oil [EB], revision number 9” which states in paragraph 4.2.1 that the modification of any piping system, sensing tube, or electrical wiring associated with the oily water separator (OWS) is forbidden unless exceptionally approved by the Managing Office, vessel’s Classification Society, and Flag Administration. PSCO also observed ship SMS document “FIM Ch.F-02 Engineering Practices [EB], Revision number 4” which states in paragraph 2.1.11 that safety and relief valves are never to be plugged or gagged except when testing boiler safety valves under the direction of a classification surveyor. Reference is made to deficiencies 001 and 002, where these procedures were not followed. PSCO requires an additional external audit of company safety management system.

No person may operate any vessel equipped with installed toilet facilities unless it is equipped with an operable Type II or III device that has a label on it under § 159.16 or that is certified under § 159.12 or § 159.12a. Any vessel flagged or registered outside the United States that holds a valid ISPPC issued by its flag Administration indicating the installed sewage system complies with MARPOL Annex IV as amended by either resolution MEPC.159(55) MEPC.2(VI) will be accepted by the U.S. Coast Guard as being in compliance with U.S. regulations. PSCO observed that vessel flag Administration had given vessel dispensation to discharge sewage into aft-peak ballast tank if procedures are followed to isolate the aft-peak tank, and that that the vessel has not complied with these requirements. 33 CFR 159.7(a)(1)

The master, owner, operator, agent, or person in charge of a vessel subject to this subpart and this section must submit a ballast water report to the National Ballast Information Clearinghouse (NBIC) no later than 6 hours after arrival at the port or place of destination. Vessel arrived to port 06 Mar 2021, however NBIC report had not been received by NBIC as of 11 Mar 2021. Vessel master provided documentation that he sent the report to company and agent only, but appeared to not be further received by NBIC. PSCO educated master on reporting requirements, and report was submitted while PSCO was onboard.

Resolution: NBIC report submitted appropriately with USCG attending, and training provided to master by USCG.
