The oil discharge monitoring and control system shall come into operation when there is any discharge of effluent into the sea and shall be such as will ensure that any discharge of oily mixture is automatically stopped when the instantaneous rate of discharge of oil exceeds that permitted by Annex I, Reg 34. The ship did not disclose that the ODME is not operating as designed. The relay that controls the automatic opening or closing of overboard discharge valve is faulty, preventing automatic operation of the overboard discharge valve. The ship has the relay bridged so that it is bypassed. This arrangement causes ODME to alarm and was inoperable during testing as a result, because the jumper wire connections lost contact during transit.

The Safety Management System should ensure compliance with mandatory rules and regulations. The SMS does not address maintenance and testing of nitrogen generator. There are no established procedures for calibrating the oxygen analyzer, the instructions posted on the unit were not consulted by the crew. There are no established procedures for testing all alarms and performing routine maintenance as required by manufacturer's instructions. There are no established procedures for verifying proper operation of unit indicating required oxygen levels for testing or operation. In addition, no pre-arrival checklist, discharge checklists, or the Ship/Shore Safety Checklist (declaration of inspection) address verifying proper operation of the nitrogen generator system for cargo operations.
