The high-level alarm must activate once the cargo level reaches 95 percent of the tank capacity or higher, but before the tank overfill alarm; active a visible and audible alarm so that it can be seen and heard where cargo transfer is controlled. PSCE tested multiple tank high-level alarms and no audible or visual alarm was seen in CCR or out on deck.

The master/owner/operator of a vessel equipped with ballast tanks that operates in the waters of the United States must empoly one of the folowing ballast water management methods: install and operate a ballast water mangement system (BWMS) that has been approved by the Coast Guard. Following installation, the master, owner/operator, of the vessl subject to this subpart must properly maintain the BWMS in accordance with all manufacturers specifications. Vessel's installed BWMS was not operational. Vessel self reported non-operational treatment system.
