Objective evidence revealed that records of non-conformities, accidents and hazardous situations are not being reported in accordance with established SMS procedures. PSCO noted a lack of effectiveness and timely implementation of corrective action for previous Flag State and Port State identified non-conformities and deficiencies.

In meeting the requirement of ISM Code 10.1, the Company should ensure that any nonconformity is reported, with its possible cause, appropriate action is taken, and records of these activities are maintained. Records of inspections, maintenance, damages, defects, and relevant corrective actions were not available for review as objective evidence of the effective functioning of the SMS. Flag State, Port State, and classification society are not being notified of vessel defects, as defined in SMS Chapter 12, for damage or faulty operation of equipment which could endanger or has compromised the safety of people, the environment, and the vessel or its property.
