The Oil Record Book Part I shall be completed on each occasion, on a tank to tank basis if appropriate, whenever discharge overboard or disposal otherwise of bilge water which has accumulated in the machinery spaces. The officer(s) in charge of the operation to dispose or discharge overboard accumulated bilge water failed to log, in the Oil Record Book, the disposal, transfer, or discharge overboard of approximately 28 cubic meters of accumulated bilge water in the engine room. Resolution: Based on our findings during our inspection and the evidence presented, Sector New Orleans still feels there are omissions/inaccuracies in the oil record book, and believes these omissions and inaccuracies still exist. See narrative for full statement.

The company should ensure that the safety and environmental protection policy is implemented and maintained at all levels of the organization, both ship-based and shore based. The Safety Management and Environmental Protection section of the vessel's Procedures Manual in the SMS Chapter P11, Rev. 09, paragraph 3.6.2 states that the Chief Engineer shall control all critical operations such as collection and disposal of oil residues which can pose a pollution threat, and shall ensure that such operations are carried out in accordance with MARPOL requirements and company instructions. Furthermore, machinery space operations on the ones described above shall be recorded in the Oil Record Book in accordance with regulation 17 of MARPOL. Reference is made to deficiency 001, where PSCO observed that approximately 28 cubic meters of accumulated bilge water is unaccounted for in the Oil Record Book. Vessel requred to conduct Safety Management Audit, by the Certificate Issuing Authority, prior to release from detention. SOLAS 74(a) 2014 Consolidated IX/3.1 ISM Code 2.2

Resolution: See def 001, For the same reasons, Sector New Orleans has decided to clear the detention, but not based on the audit report presented by Flag State. Flag State decliined to reopen audit even after Sector NOLA personnel provided photo and video evidence.
