74SOLAS III/20.2 BEFORE THE SHIP LEAVES PORT AND AT ALL TIMES DURING THE VOYAGE, ALL LIFESAVING APPLIANCES SHALL BE IN WORKING ORDER AND READY FOR IMMEDIATE USE. PSCO OBSERVED PULL STARTER FOR RESCUE BOAT ENGINE FAIL WHEN ATTEMPTING AN ENGINE START. RESCUE BOAT ENGINE IS UNABLE TO START IN CURRENT CONDITION.

15109 - Maintenance of the ship and equipment The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations, and with any additional requirements which may be established by the company. Due to the objective evidence detailed in the below deficiencies, the vessel is not in substantial compliance with the relevant conventions, calling into question the adequacy and implementation of the vessel's SMS under the ISM code. Furthermore, PSCO observed objective evidence that the SMS requirements for watertight doors and watertight hatches inspection were not being adhered to. The vessel SMS had a watertight door and hatch inspection requirement of every 3-months. The last inspection was dated on 29JAN2023 and the graded by the crew as "4" on a 1-5 scale, with 1 meaning "bad" and 5 meaning "excellent", signed off by the [name withheld] An external audit conducted by Flag or RO is required to determine whether the ship is operating in accordance with the ISM Code. Provide a copy of the completed audit report to USCG prior to departure from port. 74 SOLAS (20) IX/3.1 ISM Code A/10.1

03107 - Doors All access openings in bulkheads at ends of enclosed superstructures shall be fitted with doors of steel... The means for securing these doors weather-tight shall consist of gaskets, and clamping devices, or other equivalent means. PSCO observed 06 weather-tight doors on the main superstructure that did not properly secure due to corrosion around edges, defective gaskets, and closure devices that do not secure properly. 03104 - Cargo & other hatchways The means for securing and maintaining weather-tightness shall be to the satisfaction of the Administration. The arrangements shall ensure that the tightness can be maintained in any sea conditions. PSCO observed 06 hatch covers not properly securing for weather-tightness due to excessive corrosion, defective gaskets, and closure devices that do not secure properly. ICLL (88) CH.2/16.1

07105 - Fire doors/openings in fire-resisting divisions In order to contain a fire in the space of origin, the fire integrity of the divisions shall be maintained and openings and penetrations. PSCO observed 04 damaged or modified A-0 fire doors (main deck stairwell door, main deck engineering space door, main deck stairwell door leading to engine room, and galley door) that would not prevent the passage of smoke or flame. Furthermore, PSCO observed 02 self-closing A-0 fire doors (galley door and door leading to ventilation stack) that did not operate as intended. 74 SOLAS (2014) II-2/9.1.3

09204 - Safe means of access Escape routes shall be maintained in a safe condition clear of obstacles. PSCO observed emergency exit forward of engine room was unable to open fully due to hatch cover becoming impeded by coaming of cargo hold. Due to this, the counterweight was unable to fully hold open the hatch cover in the vertical position. 74 SOLAS (2014) II-2/13.1.2

04103 - Emergency, lighting, batteries and switches Alleyways, stairways, and exits giving access to the muster and embarkation stations shall be lighted. PSCO observed multiple emergency lights on cargo deck and around superstructure either inoperable or incorrectly marked. 74 SOLAS (2004) III/11.5

13199 - Other (machinery) Suitable pressure relief arrangements shall be provided for all systems. PSCO observed on the 02 main air receivers, the pressure relief valves were present but did not have identifiable relief valve settings. 74 SOLAS (2004) II-1/34.1

02112 - Hull - corrosion The condition of the ship and its equipment shall be maintained to conform to the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. PSCO observed floodlight cover for port side cargo hold No.3A to be secured only by two bolts, rendering it non-weathertight. 74 SOLAS (2020)I/11a

09206 - Safe means of access Deck - hold/tank, etc. Effective protection for the crew in the form of guardrails or lifelines shall be provided above the deck cargo if there is no convenient passage on or below the deck of the ship. PSCO observed broken guardrail on starboard side of cargo deck, between cargo holds 2 and 3. ICLL (88) Annex I/25.5

02108 - Electrical installations in general The condition of the ship and its equipment shall be maintained to conform to the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. PSCO observed deteriorated mounting hardware for the reefer containers junction box. 74 SOLAS (2020) I/11a

07115 - Fire-dampers The condition of the ship and its equipment shall be maintained to conform to the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. PSCO observed the three fire dampers for the engine room ventilation secured in the open position using blocks and bolts screwed into the bulkhead. To close the dampers, tools were required to remove the blocks and screws and were not readily available. 74 SOLAS (2020) I/11a

15106 - Shipboard operations The Company should establish procedures, plans, and instructions, including checklists as appropriate, for key shipboard operations concerning the safety of the personnel, ship and protection of the environment. The various tasks should be defined and assigned to qualified personnel. PSCO observed crew attempting to test thermal fire-detection equipment using unapproved methods, not in alignment with manufacturer’s procedures or vessel SMS. Vessel had approved testing equipment onboard, but it failed after four testing attempts and crew attempted to use a lighter to finishing testing. 74 SOLAS (2020) IX/3.1 ISM Code A/7

15106 - Shipboard operations The company should establish procedures, plans, and instructions, including checklists as appropriate, for key shipboard operations concerning the safety of the personnel, ship and protection of the environment. The various tasks should be defined and assigned to qualified personnel. PSCO observed objective evidence that the maintenance and testing of fire-detection equipment, as required by the vessel SMS, was not being adhered to. PSCO requested crew to test detector above the main engine, crew made several attempts using test device for smoke detection. Further investigation determined that main engine detector was of a thermal detection type. Discussions with crew indicated that they were unaware of what type of fire-detection equipment was installed. 74 SOLAS (2020) IX/3.1 ISM Code A/7

18316 - Water, pipes, tanks Cold fresh water and hot fresh water available in all wash spaces. PSCO observed lack of hot water in hospital space, galley, and in 02 water closets. PWSA 46 USC 70002 ILO-147 p. 37/21(c)

11135 - Maintenance of Life Saving Appliances All life-saving appliances prescribed in this part shall be fitted with retro-reflective material where it will assist in detection. PSCO observed retro-reflective tape on rescue boat and lifeboat to be faded and deteriorated. 74 SOLAS (2020) III/34 LSA Code 1.2.2.7

09209 - Electrical Terminations and joints in all conductors shall be so made as to retain the original electrical, mechanical, flame-retarding and, where necessary, fire-resisting properties of the cable. PSCO observed unsecured dead-end wires on starboard side of cargo hold No. 2B. 74 SOLAS (2004) II-1/45.5.6

09209 - Electrical Electrical installations shall be such that the safety of passengers, crew and ship from electrical hazards will be ensured. PSCO observed 02 electrical connections in galley with grounding wires not connected. 74 SOLAS (2004) II-1/40.1.3

13199 - Other (machinery) The condition of the ship and its equipment shall be maintained to conform to the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. PSCO observed wastage around the drainpipe in the drip pan for the oil purifier equipment. The wastage in the containment allowed for oil to drip into a lower skid and saturate the lagging of piping below. 74 SOLAS (2020) I/11a

09130 - Water, pipes, tanks The condition of the ship and its equipment shall be maintained to conform to the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. PSCO observed excessive corrosion to the bottom of the forward water heater and wastage around the heating elements penetrating the side shell on both water heaters. 74 SOLAS (2020) I/11a

11126 - Means of recovery of life saving appliances The condition of the ship and its equipment shall be maintained to conform to the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. PSCO observed the davit recovery hook for the lifeboat to be wasted. 74 SOLAS (2020) I/11a

11112 - Launching arrangements for survival craft The condition of the ship and its equipment shall be maintained to conform to the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. PSCO observed a 2-inch crack on the starboard side of the lifeboat davit’s launch ramp. 74 SOLAS (2020) I/11a

06199 - Other (cargo) The condition of the ship and its equipment shall be maintained to conform to the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. PSCO observed damaged to starboard cargo hold No. 1 and a cracked container securing mount and a cracked external tripping bracket on cargo hold No. 2. 74 SOLAS (2020) I/11a
