Maintain a Ballast Water Management Plan that has been developed specifically for the vessel and allow those responsible for the plan's implementation to understand and follow the vessel's BWM strategy and comply with the requirements of this subpart. The plan must include - (1) detailed safety procedures... The Ballast Water Procedures...The Ballast Water Management Plan has no way to accurately calculate stability based on quantities retained the each tank. 33 CFR 151.2050(g)(1)

Certification of accurate information. Include the master, owner, operator, agent, person in charge, or responsible officer's.... attesting to the accuracy of the information.. in accordance with the Ballast Water Management Plan required by 33 CFR 151.2050 (g)... Ballast Water Record Book does not record latitude and longitude while at sea when operations are conducted, nor does the vessel record the capacity retained on board before any recirculating operation. 33 CFR 151.2050 (a)(2)

The Ballast Water Report required by paragraph (b) of this section must include the following information: Ballast Water Information. This includes the vessels total ballast water capacity... total volume of Ballast Water Onboard... Vessel's report of ballast water reported total ballast water capacity is 186m^3 when the total is actually 411 m^3. Vessel also declared 80 m^3 ballast water retained when there is no means to ascertain capacity. 33 151.2060(c)(3)

Life-Saving Appliances required by this chapter should comply with the technical specifications of LSA code... limit switch missing from rescue boat davit. CCSSC 4.3.1 LSA Code 6.1.2.7

A main source of electrical power of sufficient capacity to supply all those services... shall be provided. Vessels port side generator is non-operational and being supplemented by a temporary installation on deck.

All cargoes...shall be loaded, stowed and secured throughout the voyage in accordance with the Cargo Securing Manual approved by the administration. Palletized cargo on deck not protected against the elements as required by section 3.3.3 of the ship's Cargo Securing Manual. Additionally, cargo is stowed on parts of the deck that are marked as passageways. 74SOLAS(14CONS) CH. VI/Reg 5.6

Each operation described in paragraph 2 of this regulation shall be fully recorded without delay in the Oil Record Book part I, so that all entries in the book appropriate to that operation is complete. Oil Record Book entry dated 08/22/19 report a quantity of 615 gallons in the ship's sludge tank. An entry dated 09/01/2019 records a transfer of 7 gallons into the tank with a total quantity retained of 1,113 gallons. There is no record of where the additional oily waste was transferred from. Additionally, a sounding of the sludge tank on 11/02/2019 shows a quantity of 1,380 gallons. Records reflect an off load of sludge to a Mobil facility of 1,200 gallons on 11/07/2019. An entry on 11/07/2019 to record the amount retained in the sludge tank says 0.0 gallons. There is nothing logged accounting for the remaining 180 gallons. MARPOL (17 Cons) Annex I/17.4

...These requirements shall be recorded in form of record of ship equipment and information attached to the safety certificate. Vessel is equipped with a BNWAS. This equipment is currently inoperable and is not listed on any of the required certificates. CCSSC (2018) 6.1.1

In ships of 50M in length and over at least 02 lifebuoys provided with self-igniting lights shall also be provided with self-activating smoke signals. Each of these lifebuoys capable of quick release from the navigation bridge where practicable or be of the throwover type. Lifebuoys required with smoke and light are designed as throwover type however their arrangement; secured directly to the superstructure with railing separated at approximately 4 feet, prevents smoke and light from being discharged when lifebuoys are thrown as designed. CCSSC 4.12.3 16bc

2120-Garbage-Every ship of 400 gross tonnage and above... shall be provided with a Garbage Record Book. The Garbage Record Book... shall be in the form specified in Appendix II to this Annex. Garbage Record Book is missing dates and signatures. Discharges of operational wastes are not being logged in the Rocord Book.

Every Seafarer holding a certificate issued under the provisions of the Convention, who is serving at sea, shall also hold a valid medical certificate. Chief Engineer and 2nd Engineer had expired medical certificates. 02 Able Seamen did not have valid medical certificates. STCW Reg I/9.3

Rescue boates shall be stowed: In a state of continuous rediness for launching in not more than 5 min. While attempting to launch the rescue boat, the remote brake cable became tangled and the crew was not able to lower or raise the boat. CCSSC 4.9.8.1

All new and existing vessels operating in area III and Unrestricted shall be provided with: An echo sounder. Echo Sounder would not provide accurate reading for the charted depth. CCSSC 6.4.4.1.1

All new and existing vessels operating in area III and Unrestricted shall be provided with: ALDIS lamp. ALDIS lamp battery would not hold a charge. CCSSC 6.4.4.1.1

The certificate referred to in 1.12.1 shall be supplemented by a Record of Equipment and Ship Information which shall be permanently attached thereto. Record of equipment did not coincide with the Minimum Safe Manning document and had conflicting engine room manning designation. The Record of Equipment also had incorrect wattage to the engine power when compared to the EIAPP. CCSSC 1.12.1

CCSSC Ch.3/Reg 3.13.2 - In all such ships fire control plans shall be kept up to date. Quantity of external fire suppression for paint locker is not documented on fire control plan.

MARPOL (2011 cons) Annex V/Reg10.3 - Every ship 400 gross tonnage and above shall be as the form in this appendix. Signature of officer in charge of operation is missing on 03 pages of the Garbage Record Book.

CCSSC Ch.1/Reg1.11.1 - The ships equipment shall be maintained to ensure the ship will remain fit to proceed to sea without danger to ship, persons on board or the environment. Engine room starboard side smoke/heat detector is inoperable.

01 - 1510 - Every compass shall be fitted with a compass designed for marine use. 15 degree variance between heading and bridge compass reading found. CCSSC 6.4.1

02 - 1430 - A main source of electrical power of sufficient capacity to supply all electrical services necessary for maintaing the ship in normal operations shall be provided. STBD generator found inoperable. CCSSC 2.28

03 - 0740 - CCSSC CHAP 3.3.10.1 AN EMERGENCY FIRE PUMP SHALL BE POSITIONED OUTSIDE THE ENGINE ROOM AND PERMANENTLY CONNECTED TO THE FIREMAINS. THE USE OF PORTABLE FIRE PUMPS SHALL BE AVOIDED. SHIP DOES NOT HAVE FIXED EMERGENCY FIRE PUMP.

0199 - Other (load lines) - No certificate should be extended for a period longer than one month. The vessel's CCSS Certificate was originally valid until January 4th, 2016 but received a validity extension until April 16, 2016. CCSS Code CH 1/ Reg. 1.13.5
