Fire fighting systems and appliances shall be kept in good working order and readily available for immediate use. PSCO observed insuffient water from the emergency fire pump.

The arrangements of sea connections, fire pumps and their source of power shall be as to ensure that: if a fire in any compartment could put all the pumps out of action, there shall be an alternative means consisting of an emergency fire pump complying with the provision of the Fire Safety Systems Code. Crew could not prove of proper operation of the emergency fire pump. 74 SOLAS (2020) II-2/10.2.2.3.1.2.

The maintenance plan shall include at least the following fire protection systems and fire-fighting systems and appliances, where installed: fixed fire detection and fire alarm systems. SOLAS maintenance log book does not address procedures or intervals for fire alarm and detection system testing or maintenance. 74 SOLAS (2020) II-2/2.2.3.2

Maintenance, testing and inspections shall be carried out based on guidelines developed by the Organization and in a manner having due regard to ensuring the reliability of fire-fighting systems and appliances. PSCO observed 03 portable fire extinguishers where monthly maintenance had not been conducted.

The Safely management system should include procedures ensuring that non-conformities, accidents and hazardous situations are reported to the company, investigated, and analyzed with the objectives of improving safety and pollution prevention. Crew did not report inoperable emergency fire pump in accordance with SMS section 7.1.3.3 (Defect reporting system) 74 SOLAS (2020) IX/3.1 ISM Code 9.1

Every company should develop, implement and maintain a safety management system which includes the following functional requirements: instructions and procedures to ensure safe operation of ships. Ships safety procedure plan section 3.14 (Procedures for Lock-out/Tag-out) states that equipment should be physically locked-out. PSCO observed sheet of printer paper over the general service fire pump panel and aux generator # 3 panel stating do not start. 74 SOLAS (2020) IX/3.1 ISM Code Part 1.4.2

A copy of the certificate of compliance issued by the testing facility, stating the date of compliance and the applicable performance standards, shall be retained on board the ship. Crew unable to provide a valid certificate of compliance. 74 SOLAS (2020) V/18.8

No person may cause a vessel to enter into or get underway on the navigable waters of the United States unless the following equipment has been tested: main propulsion machinery, ahead and astern. Chief Engineer stated that power failure tests were not completed. 33 CFR 164.25(a)(5)

The company should establish procedures to ensure that the ship in maintained in accordand with the provisions of the relevant rules and regulations established by the company. The technical and/or operational nature of the deficiences 2,3,4,5 provide objective evidence of a serious failure of the implementation of the ISM code. An internal audit report satisfactory to the OCMI must be submitted within 90 days to clear this deficiency. 74 SOLAS (2020) IX/3 ISM Code 10.1

THE CONDITION OF THE SHIP AND ITS EQUIPMENT SHALL BE MAINTAINED TO CONFORM WITH THE PROVISIONS OF THE PRESENT REGULATIONS TO ENSURE THAT THE SHIP IS ALL RESPECTS WILL REMAIN FIT TO PROCEED TO SEA. VESSEL EXPERIENCED MULTIPLE LOSS OF PROPULSION EVENTS WHILE ATTEMPING TO GET UNDERWAY. MANDATORY IN PERSON SURVEY/ATTENDANCE REQUIRED TO CLEAR DEFICIENCY. SOLAS 74 AS AMENDED 1-11

The company and the ship shall comply with the requirements of the International Safety Management Code. The technical nature of deficiencies 02, 03, 04, 05, 06, 07, and 08 provide objective evidence of a serious failure, or lack of effectiveness, of the implementation of the ISM Code. Additionally, the vessel failed to notify the flag state and port state, U.S. Coast Guard, of hazardous conditions prior to its inbound transit/berthing—the engine room’s localized fixed fire extinguishing system and two (of three) auxiliary diesel generators were found to be out of service. A safety management audit carried out by the Administration or the RO, with a corresponding report of findings satisfactory to the OCMI must be submitted prior to clearance of this deficiency and release from detention. 74 SOLAS (20) IX / 3.1 30ABC

2. Means shall be provided to control leaks of flammable liquids. PSCO observed incredibly excessive oil leaks/splatter, oil-soaked lagging, and quantities of pooled oil in bilges/catchments throughout the entire engine room, especially on/around the fuel oil purifier room, main diesel engine, auxiliary generators 1/2/3, and incinerator room. More than a dozen 55-gallon drums and various sized buckets were found filled with oil and exposed, littered across the engine room. Excessive hydraulic oil leaks were also found on the steering gear and power pack for the aft mooring winch. 74 SOLAS (04) II-2 / 4.2.2 30ABC

The system should be available for immediate use and capable of continuously supplying water for at least 30 min in order to prevent re-ignition or fire spread within that period of time. PSCO observed the water mist tank supplying the engine room’s localized fire extinguishing system empty and out of service with hatch cover removed. 4. A main source of electrical power of sufficient capacity to supply all those services mentioned in regulation 40.1.1 shall be provided. This main source of electrical power shall consist of at least two generating sets. PSCO observed auxiliary generators 1 & 3 out of service. Auxiliary generator 2, the only generator operational, was found operating with open covers, no insulation on hot spots, and excessive fuel/oil leaks with flywheel valley tray filled with oil. 74 SOLAS (20) II-1 / 41.1.1 30ABC

5. The following fire protection systems shall be kept in good order so as to ensure their required performance if a fire occurs: fire detection and fire alarm systems. PSCO observed an engine room smoke detector inoperable and covered with a plastic bag. Flame detectors above auxiliary generators 2 & 3 were non-operational when tested. 74 SOLAS (04) II-2 / 14.2.1.1.2 30ABC

Fire protection systems and fire-fighting systems and appliances shall be maintained ready for use. PSCO observed the #1 engine room fire pump excessively leaking water and unable to maintain satisfactory pressure. Also, a temporary pipe patch was found on the system with a significant leak into the bilge. 74 SOLAS (04) II-2/ 14.1.1 30ABC

Doors required to be self-closing shall not be fitted with holdback hooks. However, hold-back arrangements fitted with remote release devices of the fail-safe type may be utilized. The self-closing A-0 door between the main engine room and fuel oil purifier room was unable to close properly, and 02 self-closing A-0 doors within the galley/mess deck/scullery were held open with hold back devices. 74 SOLAS (04) II-2/ 9.4.2.2 30AC

Ships shall be designed, constructed and maintained in compliance with the structural, mechanical and electrical requirements of a classification society which is recognized by the Administration in accordance with the provisions of regulation XI-1/1, or with applicable national standards of the Administration which provide an equivalent level of safety. External starboard upper deck accommodation ladder is materially compromised by sheared off bracket pin. 74 SOLAS (20) II-1/3-1 30ABC
