The company shall establish procedures to ensure that the ship is maintained in the conformity with the provisions of the relevant rules and regulations and with any additional requirements which may be established by the company. In meeting these requirements, the company should ensure that: any non-confirmity is reported, with its possible cause, if known. In Section 8.8 of the vessel's SMS procedures, the ship's actions for "Cargo Shifting (which may be danger to the safety of the ship)" in the port shall be the master shall notify the representative in local port... Vessel substained damage to cargo hold #2 and starboard ballast tank causing damage to cargo containers and water ingress in cargo hold #2 on February 3rd, 2022 while at sea transiting from China to Houston. Vessel arrived into Sector Houston-Galveston COTP Zone on March 8th, 2022 and failed to notify USCG of the damage substained to cargo containers and starboard ballast tank and proceeded to discharge cargo. Vessel is not to resume cargo operations until approved by Sector Houston-Galveston. An internal audit is required within 90 days. 74 SOLAS (20) IX/ 3.1 ref ISM Code 10.1 & 10.2.2
