To discharge ballast water into the waters of the U.S., the master, owner, operator, agent, or person in charge of a vessel subject to 151.2025 of 33 CFR must either ensure the ballast water meets the ballast water discharge standard in 151.2030(a), use an AMS as described in 151.2020(a)(3), or ballast with water from a U.S. public water system, according to the schedule in paragraph(b). Subject vessel in past its compliance date per extended compliance letter. Vessel is fitted with BWTS but was not used and vessel intended to discharge untreated ballast into U.S. waters. As vessel is past its compliance date, discharge of untreated ballast into U.S. waters is not permitted. 33CFR 151.2035.

Resolution: Vessel exited US waters to conduct ballast water exchange and treatment prior to requesting permission to re-enter port for cargo operations and the necessary de-ballasting operations.
