In order to discharge ballast water in the waters of the United States, the vessel must use a Ballast Water Management System (BWMS) type approved by the U.S. Coast Guard use an alternative Management System (AMS), or use a ballast with water from the U.S. Public Water System (PWS) according to the schedule in paragraph (b), This existing vessel, keel laid in 2010, with a ballast capacity of 14,305 cubic meters, has passed its compliance date and has not installed a BWMS or AMS. Prior to discharging untreated ballast waters of the U.S., the vessel must comply with one of the approved ballast water management methods listed in 33 CFR 151.2035(a). This deficiency will not be cleared until CG inspectors receive information that the vessel installs a BWTS, AMS, or decides to use only public waters for the U.S. Public Water System.

The vessel equipped with ballast water tanks that operates in the waters of the U.S must: maintian a ballast water management plan that has been developed specifically for the vessel and that will allow those responsible for the plans implementation to understand and follow the vessel's ballast water management strategy and comply with the requirements of this subpart. Vessels ballast water managaement plan does not include any of the provisions listed in 33 CFR 151 Subpart D. Vessels ballast water management plan must include the provisions in 33 CFR 151.2050(g).
