THE COMPANY SHOULD ENSURE THAT ALL PERSONNEL INVOLVED IN THE COMPANY'S SAFETY MANAGEMENT SYSTEM HAVE ADEQUATE UNDERSTANDING OF RELEVANT RULES, REGULATIONS, CODES, AND GUIDELINES. SHIP'S CREW DID NOT PROPERLY RECORD FAILURE OF THE OILY WATER SEPARATOR OIL-LEVEL DETECTOR ALARM AND DID NOT RECORD TANK-TO-TANK TRANSFERS BETWEEN THE F/O DRAIN TANK AND THE PORT BILGE OIL TANK IN THE OIL RECORD BOOK PART I. FURTHERMORE, THE CREW DID NOT MAKE ALL REQUIRED ENTRIES IN THE GARBAGE RECORD BOOK WITH SEVERAL ENTRIES MISSING THE REQUIRED DESCRIPTION OF GARBAGE AND/OR QUANTITY OF GARBAGE DISCHARGED. MOREOVER, THE CREW WASHED ENGINE ROOM BILGES WITH DETERGENTS AND DISPOSED OF THE CLEANING WATER THROUGH THE OILY WATER SEPARATOR DESPITE WARNINGS IN THE SHIP'S OPERATIONS MANUAL.
DUE TO THE NUMBER AND NATURE OF DEFICIENCIES IDENTIFIED DURING THE EXAM, IT WAS DETERMINED THAT THE SHIP FAILED TO IMPLEMENT OR MAINTAIN THE REQUIREMENTS OF THE INTERNATIONAL SAFETY MANAGEMENT CODE. RECOMMEND AN EXTERNAL SMS AUDIT. 74 SOLAS (2014) IX/3.1,ISM CODE A/6.4.

1199 - Except as provided in paragraph (d) of this section, no person may use any equipment listed in paragraph (c) of this section for transfer operations unless the vessel or facility operator, as appropriate, tests and inspects the equipment in accordance with paragraphs (b),(c),and (f) of this section and the equipment is in the condition specified in paragraph(c) of this section. Vessel could not provide proper documentation on testing and set point of the cargo system pressure relief valve, nor could vessel provide proper documenation to show that the cargo transfer piping has not leaked under a static liquid pressure at least 1.5 times the MAWP as required under 33 CFR 156.170(c)(2) and (c)(4) respectively. These items must be provided to the satisfaction of the attending Coast Guard Inspector, prior to conducting cargo transfers in U.S waters.
