Control exercised by a duly authorized control officer under article X shall be limited to the following: verification that the numbers and certificates of the seafarers serving on board are in conformity with the the applicable safe manning requirements of the Administration. Vessel's minimum safe manning document requires (1) Master 0perating under a STCW II/2 certification. Based on the on Master's 10 MAY 2017 expiration and no other crew member possessing a II/2 certification the vessel was not manned IAW the Flag State Requirements STCW 78/95 Regulation I/4.1.2 STCW 78/95 Regulation I/14.1.2 30(b)(c)

Control exercised by a duly authorized control officer under article X shall be limited to the following: verification in accordance with article X(1) that all seafarers serving on board who are required to be certified in accordance with the convention hold an appropriate certificate or a valid dispensation, or provide documentary proof that an application for an endorsement has been submitted to the administration in accordance with regulation I/10, paragraph 5. The Master's Panamanian STCW II/2 credential had an expiration date of 10 May 2017. On 30 November 2017, the company submitted his expired license to Vanuatu Maritime Affairs to obtain a Flag State endorsement. Vanuatu Maritime Affairs provided a confirmation receipt of application granting him the allowance to sail on board a Vanuatu Flag vessels for a 90 day grace period even-though the submitted license was 6 month passed it's expiration date when the application was submitted and received by the Flag Administration. Objective evidence discovered during an expanded ISM exam revealed the following non-conformity. The Company should ensure that each ship is manned with qualified, certified and medically fit seafarers in accordance with National and International requirements. The vessel's Master signed on board 18 JUN 2017 and the company contrary with STCW I/14 failed to verify that the master had a valid license. The company submitted an application for an endorsement on 30 NOV 2017 on behalf of the Master, who did not have a valid license and who had been operating on the vessel for five months and therefore recommend an external audit. 74 SOLAS(14) IX/3.1 ISM CODE 6.2 30(b)(c)

Every ship to which this code applies shall be sufficiently and efficiently manned in order to ensure the safe operation, security of the ship and protection of the environment. The vessel's Master is operating under a license that expired on 10 May 2017. CCSSC Ch 1 Regulation 1.7.1 17(b)(c)

The attending marine inspectors discovered that the #3 starboard fuel tank was leaking diesel fuel in to the navigable water of the US. The source of the leak was found to be a abandoned 4" pipe coming from the machinery space through the #3 starboard fuel tank and ended on the side of the hull as a water discharge pipe.

01 - 1699 - All vessels over 300GT except those assigned to restricted area one shall be fitted with a LRIT approved by the Administration. The vessel operates in restricted area II therefore the vessel must have the LRIT installed on the vessel. CCSSC(2015)6.4.4.3 -50bc

02 - 1499 - All electrical apparatus shall be constructed and so installed as to not cause injury when handled or touched in the normal manner. Batteries for port side generator were not secured. CCSSC(2015) 2.27.1.3 -50bc

Objective evidence discovered during an expanded ISM exam revealed the following non-conformities. These discrepancies, included with the other material deficiencies, are evidence that the ship and/or company are not meeting the requirements of the ISM Code. Recommend an external audit. There shall be provided (in) any space containing internal combustion machinery (with) a total power output of 750KW and above: one of the fixed fire extinguishing systems referred to in 3.10.1. The vessel does not have a fire suppression system for the engine room containing internal combustion machinery in excess of 1250 KW and has a certificate endorsed for unrestricted service. CCSSC 3.10.3.1.

The owner of every ship shall ensure that the condition of the ship is maintained to conform with the provisions of this Code. The fire main in the engine room has an active leak, and there are numerous repairs and patches that have not been approved by the Flag. CCSSC 1.11.

All exposed surfaces in corridors shall have low flame-spread characteristics. There is a 7ftX8ft section of wooden bulkhead in the main passageway which is all that separates the ventilation duct serving crew spaces and the bridge from the galley on the other side of the passage way. CCSSC 3.17.3.1.

Combustible materials that are not needed in the cooking area shall not be stored in the area. Galley has excessive combustible storage. CCSSC 3.23.5.

In the event of failure of electrical power supply to main steering gear control or power unit, an alarm shall be given in the navigation bridge. There is no arrangement for an alarm on board, and the vessel has a certificate endorsed for an unrestricted operating area. CCSSC 2.33.7.

Every fire hose shall be provided with an approved nozzle and the necessary couplings. Both hoses used for the operational test of the fire pump were leaking between the nozzle and hose coupling. CCSSC 3.5.9

Equipment that is required by the Code to be of an approved type shall have been manufactured and approved in accordance with the design and testing requirements of the Administration. One of the fireman outfit helmets is missing the face shield, and the crew indicated their intention to modify the protective equipment by screwing holes in the helmet to connect the shield. CCSSC 1.5.3.

Training drills shall as far as practicable be conducted as if there were an actual emergency. During the fire drill, the crew lacked situational awareness and connected the fire hose to a hydrant protruding through the same engine room ventilation shaft in which the simulated fire was located and did not rig the portable fire pump. CCSSC 4.17.2.

The owner of every ship shall ensure that the condition of the ship and its equipment is maintained to conform with the provisions of this Code. The crew removed generator #2 from service without approval from the Flag or Recognized Organization due to concern that continued use will damage it. Both generators are required by the CCSSC certificate. CCSSC 1.11.

The arrangements for storage, distribution, and utilization of oil used in pressure lubricating systems shall be such as to ensure the safety of the ship and persons on board. There are numerous lubricating oil leaks from the generators; rags and makeshift shielding has been put in place to control and redirect excessive leaks creating a fire hazard. CCSSC 3.19.3.

Launching stations shall be in such positions as to ensure safe launching. When lowering the rescue boat, the davit winch wire wears on the davit arm causing friction, smoke, and heat. CCSSC 4.9.1.

All machinery installations shall be so installed and protected as to reduce to a minimum any danger to persons on board, due regard being paid to hot surfaces. Exhaust lagging in the engine room is compromised, causing temperatures so hot that the paint has been removed on the fire main piping inches above the exhaust piping for the port main engine. CCSSC 2.3.

Each drain and scupper is closed by the mechanical means required by 155.310. All bunkering containment drains are closed by wooden plugs. 33 CFR 156.120(o).

Main and emergency switch boards shall be so arranged as to give easy access as may be needed to apparatus and equipment without danger to personnel. Galley switchboard is blocked by a buffet table. CCSSC 2.27.2.

An existing ship that cannot maintain compliance with the provisions of this Chapter shall not be assigned Restricted Area III and Unrestricted by the Administration. The Recognized Organization issued the vessel a certificate with an endorsement for unrestricted service despite the absence of a required fire suppression system or a steering gear electrical power failure alarm. CCSSC 3.1.2.

The certificates issued under 1.12 shall be readily available on board for examination at all times. The agent took all the certificates and did not leave copies on board. CCSSC 1.15.1.

When ever an accident occurs to a ship or a defect is discovered a request should be made immediately to the Administration responsible for issuing the relevant certificate for a survey as may be required by 1.10 be carried out as soon as practicable. Port engine saft coupling bolts connecting to transmission were sheered while maneuvering causing engine to loose propulsion. CCSSC CH. 1.11.3 60bc

VESSEL IS REQUIRED MEANS OF PROPULSION FOR THE RESCUE BOAT. VESSEL HAS OUTBOARD ENGINE ONBOARD THAT WILL NOT START. VESSEL IS TO PROVIDE OPERATIONAL TEST OF ENGINE TO SATISFACTION OF USCG BEFORE DEPARTURE.

The Oil Record Book contains entries indicating oil contaminated water from the engine room bilges were pumped overboard into the sea. Ships Safety Management Manual Section 8 indicates oily waste shall be stored aboard according to MARPOL requirements and discharged to shore facility. Ship’s crew confirmed that oily bilge water was routinely pumped overboard. Address to the sat of Class/Flag.

Navigational Charts and nautical publications necessary for the intended voyage are not adequate and up to date. Address to the satisfaction class/ Flag State the full inventory of navigation charts and publications according to the Safety Management Manual are corrected up to date.

The hydrostatic release for the EPIRB expired October 2009. Inspection reports indicated it was Satisfactory. To the satisfaction of the Administration

It is apparent that the gauges on both ships service generators are not operating in accordance with manufactures specifications. Several gauges are also missing. The vessel's sound powered phone system appears to be inoperable. Ship should be provided with at least 2 independent means for communicating orders from navigation bridge to machinery space. to the satisfaction of the Administration.

Vessel does not have operational fire pump of delivering a jet of water as required. No reports of non-conformity were submitted to the company an corrective actions has been taken. to the satisfaction of the Administration

There are no instruction manuals onboard for machinery, equipment and systems associated with propulsion power generation and support systems in the engine room. To the satisfaction of the administration

Ballast Water Management Plan is not vessel specific, no one is specified as responsible for implementation of the plan, the crew is not trained on the application of the Ballast Water Management Plan and sediment management procedure. BWM report is inaccurate. To the satisfaction of the Administration.

There's objective evidence that the safety management system on board the vessel is not in accordance with environmental protection policy. There's evidence logged in the oil record book and statements from the captain and engineering officer stating that engine room bilge water is discharged overboard directly in opposition to company policy listed in the safety management plan. See narrative.

33U.S.C.1321(j)(5)(G)-NTVRP #05741 must provide a signed certification that the vessel owner or operator have "ensured by contract or other means approved by the President, the availability of private personnel and equipment necessary to respond, to the maximum extent practicable, to a worst case discharge or a substantial threat of such a discharge".

33U.S.C.1321(j)(5)(D)(iii)-NTVRP #05741 should verify the worst case discharge for each vessel in the plan.

Vessels Cargo Ship Safety Certificate requires 6 hand held and 6 parachute flares. Only 2 parachute flares found on board were valid. The vessel is only required 6 parachute flares to meet the code.

Vessel is required a line throwing aparatus with 2 lines and 2 rockets. Only 01 line is on board. Vessel is to meet the requirements of their CCSSC certificate within 7 days to the satisfaction of the USCG.

REMOVE OILY WATER MIXTURE FROM BILGES IN THE ENGINE ROOM. PROVIDE RECIEPT FOR PROOF OF REMOVAL OF OILY WASTE MATERIAL TO AN APPROVED FACILITY.

PROVIDE A JACOB LADDER IN WAY OF RESCUE BOAT AREA TO PROVIDE ALTERNATE ACCESS FOR THE CREW.

INSTALL EMERGENCY LIGHTING TO THE RESCUE BOAT LAUNCH STATION AND EMBARKATION AREA IN ACCORDANCE WITH SUBCHAPTER "J".

REPAIR HYDRAULIC LEAK AT BASE OF RESERVIOR AND CONDUCT A FUNCTION TEST.

PROVIDE WIRING SUPPORT AND METAL STRAPPING TO WIRES TO STEP-UP TRANSFORMER & SWITCH CONTROL PANEL IN MSD ROOM FOR THE DAVIT RESCUE BOAT SYSTEM.

Prior to carrying freight for hire a rescue boat must be installed IAW 46CFR199.262(a) to the satisfaction of an attending marine inspector.
