The master, owner, operator, agent, or person in charge of a vessel equipped with ballast tanks that operates in the waters of the United States must employ one of the following ballast water methods listed in 33 CFR 151.2025. The vessel is not outfitted with a ballast water management system (BWMS) or a USCG approved alternate management system (AMS). the vessels implementation date, IAW table 33 CFR 151.2035(b) has expired. The vessel is prohibited from discharging ballast water in US waters unless such ballast water was recieved from a U.S. Public Water System as described in 33 CFR 151.2025(2) 33 CFR 151.2025
