The condition of the ship and its equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. 74SOLAS(20)I/11(a) PSCO observed 01 soft patch repairs on the OWS pipe before the 3-way valve and 01 on a freshwater pipe.

PSCO observed non-approved slices and exposed wiring on all life raft embarkation lighting.

As a minimum, these shall be capable of measuring concentrations of oxygen, flammable gases, hydrogen sulfide and carbon monoxide prior to entry into enclosed spaces. 74SOLAS(20)XI-I/7 PSCO observed on-board atmosphere testing equipment is incapable of measuring required gases.

15111 - Company Verification, Review and Evaluation - Objective evidence discovered during an expanded ISM exam revealed the following non-conformities: The vessel failed to fully implement the requirements of the ISM Code through their SMS procedures as evident by the following identified deficiencies indicating that the ship and/or company are not meeting the SMS requirements. Recommend an external audit. NO. 1: Vessel is failing to properly report items of non-conformity to their company. Vessels Engineer's Alarm has not worked since the Chief Engineer has been onboard. There is no record of the vessel reporting the non-conformity to company. - ISM 9.1 NO. 2: The company is failing to report non-conformities, that are reported, to the flag and class of the vessel. Vessel reported the alarm system in the engine room monitoring the main engine exhaust gas temperature and jacket water cooling outlet was not working on 04OCT21. Vessel does not have any record from flag or class stating that they are safe to sail. - ISM 9.2 - 74 SOLAS (20) IX/3.1 - 15abc

To discharge ballast water into the waters of the United states the master, owner, operator, agent or person in charge of a vessel subject to 151.2025 of this subpart must either ensure that the ballast water meets the ballast water discharge standards in 151.2025(a)(3) or ballast with water from a US public water system according to the schedule in paragraph (b) of this section. Aubject vessel of the keel laid date 05JUN2012 and ballast water capacity of 5947.76 m3 is past its compliance date per the implementation schedule to 33CFR151.2035(b). Currently the vessel's BWTS is inoperative. Vessel is not authorized to discharge untreated ballast water into the waters of the US without prior authorization from the local COTP under 33CFR151.2040(b)
