The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with any additional requirements which may be established by the company. The technical and operational nature of deficiencies 02, 03, 04,05, 06, 07, 08, 09,10 provide objective evidence of a serious failure of the implementation of the ISM code. In addition PSCO observed the vessel failed to follow their SMS reporting and response procedures following pollution spills on 24 and 25 September 2024 as required by ISM Code 9.1. An external audit report satisfactory to the COTP must be submitted prior to clearance of this deficiency. 74 SOLAS 20 IX/3.1 ISM Code 10.1

Several witnesses observed and reported a sheen emanating from the vessel. PSCO observed an oily residue within one of the vessel's overboard discharge pipes on the inboard side. PSCO visually inspected the PS wash water tank and verified the oil was present. The carraiage of dangerous goods in solid form in bulk shall be in compliance with the relevant provisions of the IMSBC Code, as defines in regulation VI/1-1.1. Where a solid bulk cargo is specifically listed in appendix 1 to this code, it shall be transported in accordance with the provisions in its schedual in addition to the provisions in sections 1 to 10 and 11.1.1 of this code. PSCO observed multiple electrical discrepencies in lighting connections in hazardous area of the cargo block while vessel was loading coal. General requirements for coal section 2.2 of IMSBC require electrical cables and components in the cargo area to be free of defect prior to loading.
