The Company should establish a safety & environmental protection policy which describes how the objectives of 1.2 will be achieved to include avoidance of damage to the environment, in particular to the marine environment and to property. Section 7.14 of the vessel's Pollution Prevention, Bilges and Wastes Policy procedure 5.1, states all bilge, oily water and similar wastes shall be gathered in tanks given in I.O.P.P. certificates and shall be given into the tanker or coast for dispose at proper port. All cautions taken in such regard being for minimizing pollution caused during bilge/waste transfer shall be observed with care in most prominent manner. Deficiencies 02, 04, & 05 provide objective evidence the company SMS procedures were not followed. An external Safety Management System audit is to be performed by the Administration or RO, prior to release from detention.

In meeting these requirements, the company should ensure that records of these activities are maintained. Section 7.14 of the vessel's Pollution Prevention, Bilges and Wastes policy section 5.6.3 states the Chief Engineer has to assure that the operations of bilge and incinerator system equipment and fittings (pump, electric cable and valves, pipe lines, alarm systems, emergency stop mechanism, sample point, standard discharge connection, filter, etc...) were good, orderly reviewed and maintenance was carried out. The Oil Content Meter (OCM) manufacturer's instruction manual, Section 5 requires weekly, yearly and 5 year maintenance. Upon request by PSCO, vessel could not provide current weekly maintenance records for the OCM in accordance with manufacturer's instruction manual, thus providing objective evidence that company SMS procedures were not followed. An external Safety Management System Audit is to be performed, by the administration or RO, within 90 days.

In addition, it shall be provided with alarm arrangements to indicate when this level cannot be maintained. The system shall also be provided with arrangements to ensure that any discharge of oily mixtures is automatically stopped when the oil content of the effluent exceeds 15 ppm. In considering the design of such equipment and approvals, the Administration shall have regard to the specification recommended by the Organization. Coast Guard observed oil filtering equipment (oily water separator) automatic stopping device (three-way valve) as not operational.
