The Company should establish procedures to ensure that the ship is maintained in accordance with the provisions of the relevant rules and regulations established by the company. The technical and operational nature of the deficiencies noted below provide objective evidence of a serious failure of the implementation of the ISM Code. The housekeeping of living accommodation; deck, engine and catering department store rooms; paint and steering gear rooms and other such spaces to ensure the avoidance of situations presenting a fire hazard. PSCO observed 02 cabins and 01 storage locker within the accommodation spaces to have been modified from the labeled crews rooms into a work space containing tools, grease, bottles of fuel, paint, paint thinner, and other flammable materials. All surfaces had a layer of grease and second inspected cabin contained at lease 50 bottles of hand sanitizer stored loose amongst combustible materials. Storage room attached to gymnasium heavily smelled of paint, and door could not be fully opened to determine source of contamination. The purpose of this regulation is to prevent the ignition of combustible materials or flammable liquids. For this purpose, the following functional requirements shall be met; means shall be provided to control leaks of flammable liquids; means shall be provided to limit the accumulation of flammable vapours; the ignitability of combustible materials shall be restricted; ignition sources shall be restricted; ignition sources shall be separated from combustible materials and flammable liquids. PSCO observed the storage of flammable materials within 02 modified cabins, in which one cabin contained not only grease, paint and fuel, but sources of ignition heat and sparking producing electrical tools stored next to and also contaminated with combustible materials. Second cabin contained large quantities of hand sanitizer loose amongst other combustible materials and both bathrooms smelled heavily of paint fumes. Gymnasium storage room contained paint cans laying on their sides and smelled heavily of paint fumes and was packed so heavily of contaminated combustible materials that the door could not be fully opened. 74 SOLAS (09) II-2/4.1.1-.5 17ac

In addition to complying with the specific provisions for fire integrity of bulkheads and decks of cargo ships, the minimum fire integrity of bulkheads and decks shall be prescribed in Tables 9.5 and 9.6. PSCO observed the modification of 02 crew cabins and 01 storage space with both class B bulkheads and class B doors into high risk service spaces requiring class A bulkheads and class A doors. Culkhead separation of spaces containing paint, fuel, paint thinner and other equipment and flammable stores from accomodation spaces and corridors are inadequate. 74 SOLAS (09) II-2/9.2.3.3.1

For this purpose the following functional requirements shall be met: means of control for the air supply to the space shall be provided; means of control for flammable liquids in the space shall be provided and the use of combustible materials shall be restricted. PSCO observed improperly stored flammable and combustible materials loose inside accomodation spaces designated as crew cabins and gym storage. Collection of flammable vapors in these spaces could be clearly smelled. No specific means of control for the air supply inside these spaces are identified. 74 SOLAS (09) II-2/5.1 17ac

Paint lockers shall be protected by: a carbon dioxide system...a dry powder system...a water spraying or sprinkler system... a system providing equivalent protection, in all cases the system shall be operable from outside the protected space. PSCO observed cans of paint stored in spaces not designated as paint locker and lacking these protections. 74 SOLAS (09) II-2/10.6.3.1 17ac

All ships which undergo repairs, alterations, modifications and outfitting related thereto shall continue to comply with at lease the requirement previously applicable to these ships. PSCO observed modification of 02 cabins and 01 gym storage into spaces containing the storage of flammable and combustible materials which requires an increase subdivision level between these spaces and accomodation spaces and corridors. 74 SOLAS (14) II-1/1.3 17ac

Crew accomodation shall be maintained in a clean and decently habitable condition and shall be kept free of goods and stores not the personal property of the occupants. The master, owner, operator, agent, or person in charge of any vessel equipped with ballast water tanks that operates in the waters of the United States must follow these practices; remove fouling organisms from the vessel's hull... and dispose of any removed substances in accordance with local, state and federal regulations. PSCO observed heavy growth of marine plant life on entirety of the starboard side of hull below water line in conjunction and on areas of what appeared to be damaged anti fouling coating on the hull observed during review of paperwork and photos of last hull cleaning in march of 2024.
