The condition of the ship and its associated equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons onboard. Every company should develop, implement and maintain a safety management system which includes the following functional requirements: procedures to prepare for and respond to emergency situations. PSCO observed objective evidence that Master declared Chief Engineer (C/E) to be injured with "third degree" burns after an accident with the auxiliary boiler. Master sent detailed pictures to company medical representative regarding C/E injuries; burns to body and head. Master asked company if an expedited medical evacuation was necessary, company medical representative stated that the problem was not urgent. Later, the company determined that the C/E's injuries were severe enough that he would be unfit for duties while at sea; however, company did not expedite C/E's evacuation off of vessel. Company response does not align w/ severity of C/E's injuries, and demonstrates lack of effectiveness of implementation of ISM Code. Recommend external ISM audit for company, in addition to the previously recommended ISM audit of APL SOUTHAMPTON. 74SOLAS(20)IX/3.1 , ISM PART A/1.4.5 , 50bc

Following installation, the master, owner, operator, agent, or person in charge of the vessel must properly maintain the BWMS in accordance with all manufacturer specifications. Vessel's ballast water management system is inoperable. Vessel shall not discharge ballast water into U.S. Waters.
