The Master, owner, operator, agent, or person in charge of a vessel equipped with ballast tanks that operates in the waters of the United States must employ one of the following ballast water management methods: (1) Install and operate a ballast water management system (BWMS) that has been approved by the USCG under 46CFR162. The vessel does not have a USCG approved BWMS which they were required to install after next scheduled drydocking after September 1, 2017. Their last drydock occured in April, 2019. Vessel dischared 3232 Metric Tons of untreated ballast into a U.S. Port. Vessel is restricted from ballast discharge in US waters.
