The emergency generator shall be capable of providing power for a period of at least 18 hours. The instructions next to the fuel tank state that at least 600 liters of fuel shall be maintained. Upon inspection of the fuel tank level, it was discovered that the tank guage was inoperable and manually sounding the tank showed there was only 525 liters of fuel. Based on the generator's fuel consumption rate, only 510 liters of fuel is required to run the generator for 18 hours.

Operators in charge of a vessel equipped with ballast tanks that operate within the waters of the U.S. must install and operate a ballast water management system that is Coast Guard approved. While taking on ballast water through the Coast Guard approved ballast water treatment system in Zhoushan, China, it was found inoperable. The vessel proceeded to conduct an offshore ballast water exchange, however the ballast water was not treated through the Coast Guard approved system before entering U.S. waters.

If the installed ballast water management system stops operating properly during a voyage, the person directing the movement of the vessel must ensure that the problem is reported to the nearest COTP as soon as practicable. The vessel became aware of inoperable ballast water treatment system on 01NOV19 and the notification to the COTP for inoperative BWTS was not made until 23NOV19.
