All vessels must have navigation lights that are in compliance with the applicable sections of the International and Inland Navigation rules, except that a vessel of more than 65 feet in length must also have navigation lights that meet UL 1104. Vessel's stern light was inoperable. Vessel is restricted to daylight operations only.

Each battery must be located as high above the bilge as practicable, secured to protect against shifting with the roll and pitch of the vessel... Batteries must be mounted in trays lined with, or constructed of, a material that is resistant to damage by the electrolyte. Two (2) batteries in the pilot house were found unsecured in cabinet behind operating station.

Electrical equipment on a vessel must be installed and maintained to minimize accidental personnel contact with energized parts. All electrical equipment and circuits must be clearly marked and identified. Breaker panel on navigation bridge has unprotected and unidentified breaker openings in the panel. 46 CFR 183.200(c) and 46 CFR 183.220(d)

Unless other means are provided to ensure that a potential waste receptacle fire would be limited to the receptacle, waste receptacles must be constructed of non-combustible materials with no openings in the sides or bottom. Waste receptacles throughout the vessel are not constructed of non-combustible material.

Each child size life jacket must be stowed in a location that is appropriately marked and separated from adult life jackets so the child size life jackets are not mistaken for adult life jackets. Child sized life jackets on upper deck were stowed with adult life jackets.

Penetrations and openings in watertight bulkheads must have means to make them watertight. MI observed penetrations in port generator room watertight bulkhead.

Whenever damage or deterioration to hull plating or structural members that may affect the seaworthiness of a vessel is discovered or suspected, the cognizant OCMI may conduct an internal structural examination in any affected space including fuel tanks, and may require the vessel to be drydocked or taken out of service to assess the extent of the damage, and to effect permanent repairs. The OCMI may also decrease the drydock examination intervals to monitor the vessel's structural condition. Captain of vessel reported an unintended grounding in Newport Harbor while operating with passengers on December 15th, 2023 on or about 2100. Make vessel available for inspection for attending Marine Inspector to conduct an internal structural exam.

Vessel is restricted to Lakes, Bays, and Sounds, specifically Newport Harbor.

Waste receptacles must be constructed of noncombustible materials with no openings in the sides or bottom. All waste receptacles onboard are constructed from plastic. Provide waste receptacle constructed of noncombustible materials (metal, steel).

A passenger accommodation space must not contain any other item that could injure a passenger, unless such an item is adequately shielded or isolated. Secure CO2 tank to bulkhead to prevent shifting or damage to valve top.

A portable or temporary electric cord or cable must be constructed and used in compliance with the requirements of §111.60-13 in subchapter J of this chapter for a flexible electric cord or cable. No flexible cord may be used except: As allowed under Sections 400-7 and 400-8 of NFPA NEC 2002. NEC states: Flexible cords shall not be used as a substitute for the fixed wiring. MI observed several extension cords and power-strips being utilized to extend circuits to power multiple appliances. Remove extension cords from A/C receptacles. Prior to any modifications to approved fixed electrical installations vessel must submit electrical drawings to USCG and gain approval for proposed modifcations.

If fuel fill flexible section is a nonconductor of electricity, the metallic sections of the fill pipe separated thereby must be joined by a conductor for protection against generation of a static charge when filling with fuel. Provide bonding wires from tank to metallic fuel fill for all installed fuel tanks. Port/Starboard main and generator fuel tanks.

Except on a vessel limited to daytime operations, the compass must be illuminated. Provide a suitable marine magnet compass with means to illuminate.

Each small battery installation must be located in a well ventilated space and protected from falling objects. Provide means to cover batteries terminals under operating station

Protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock. Provide cover for electrical junction box in STBD engine room.

Propulsion machinery must be suitable type and design and design for propulsion requirements of the hull in which it is installed and capable of operating at constant marine load. Loss of propulsion in port engine while underway, due to alarm and loss of oil psi. Vessel is required to demonstrate proper operation of propulsion in the presence of a MI, prior to the carriage of passengers.

Valves for removing water or impurities from diesel fuel in water traps or strainers are permitted. These valves must be provided with caps or plugs to prevent fuel leakage. Provide cap or plug on fuel filter valve.

At each inspection for certification and at every other vessel inspection all observed unsafe practices, fire hazards must be in satisfactory condition. Repair fuel leak in starboard engine fuel return line.

Provide current and correct charts for area of navigation.

Provide current Coast Pilot.

Provide current Light List.

Provide a lanyard, at least 3 feet in length, secured around the body of one ring lifebuoy.
