Each vessel subject to load lines shall carry on board a valid certificate attesting to compliance with such load line requirements. Additionally, the master shall be responsible for having the current load line survey report on board the vessel at all times. Two of the four annual load line surveys were not completed. Renew vessel's load line certificate by an approved load line surveyor.

Exhaust gas must not leak from the piping or any connections. Port Generator has an exhaust leak in the engine room, emitting toxic gases in a manned space.

All pressure vessels must be provided with protective devices. The protective devices must be in accordance with the requirements of UG-125 through UG-136 of Section VIII of the ASME BPVC. PV tanks have no gauges, unable to determine pressure and relief valve setting, relief valves have never been serviced. Compressor and service line relief valves have been capped or are un-serviceable. Potential for over pressurization of PV tanks.

Each space accessible to passengers or used by the crew on a regular basis, must have at least two means of escape. Steering room 02 escape hatch springs are inoperable, unable to open from inside with assistance.

All passenger accommodations must be arranged and equipped to provide for the safety of the passengers. The sprinkler system protecting the passenger accommodation space is inoperable. Amend fire control plan to reflect updated fire fighting for this space.

All machinery and equipment must be installed and maintained in such a manner as to afford adequate protection from causing fire, explosion, machinery failure, and personnel injury. Excessive fuel oil leak from centrifuge gland.

All equipment shall be maintained in an operative condition . Stowage of fireman’s outfit and SCBAs in steering room are inadequate; SCBAs are un-serviceable filled with dirt and mold.

Working space must be provided around all main distribution panels and switchboards of at least 610 millimeters (24 inches) in front of the switchboard, and at least 455 millimeters (18 inches). Stowage of excess equipment in EGEN room restricting access to distribution panel.

Boundaries that separate machinery spaces from accommodation spaces, service spaces, and control spaces must be lined with noncombustible panels or insulation approved in accordance with § 164.009. A-60 insulation missing/damaged IWO of STBD fuel gauge pipe penetration ENG room, Seering room MCTs missing B-15 insulation, CO2 room lower section.

A vessel on an Oceans route must carry 6 hand red flare distress signals and 6 orange smoke signals. All smoke distress signals are expired and there are no other distress signals on board for substitution.

The marine employer must have a sufficient number of alcohol testing devices readily accessible on board the vessel to determine the presence of alcohol in the system of each individual who was directly involved in a serious marine incident. There are no alcohol testing strips on board the vessel.

Each ring life buoy must be marked in clearly legible block capital letters with the vessel's name. 01 ring life buoy on that main deck is not marked.

The master shall conduct sufficient drills to make sure that all crew members are familiar with their duties during emergencies. Fire, man overboard, and abandon ship duties have not been conducted or logged.

An inflatable life raft must be serviced at a facility specifically approved by the Commandant for the particular brand, and in accordance with servicing procedures, no later than the month and year on its sticker. 01 inflatable life raft, and it's hydrostatic release, on the port bridge wing is beyond its annual servicing date.

For fixed-gas fire extinguishing systems, the owner or managing operator must provide satisfactory evidence of the required servicing to the marine inspector. Vessel unable to provide any records of fixed CO2 fire suppression system servicing. 46CFR176.810(b)(2)

Crew acknowledged that manual operation of ventilation closure is rusted and seized in the open position. Crew stated that the only way to secure ventilation in the engine room was to use the not-serviced fixed CO2 fire suppression system. 46CFR182.465(h)

A person may not employ or engage an individual in a position required to hold an MMC unless that individual maintains a current medical certificate. Master and Mate medical certificates are expired. USCG understands delays in receiving medical certificates and impact on demand present to deliver critical supplies to Manau Islands. In order to clear this deficiency, Master and Mate must complete General Medical Exam to be documented on CG-719 Form. Medical screening that yields, “There are no conditions that pose significant risk of sudden incapacitation or debilitating complication. This exam finds no condition requiring medication that impairs cognitive ability, judgment, or reaction time” submitted to MSU American Samoa will be sufficient to clear this deficiency until the official Medical Certificate is received after submission of CG-719 to a Regional Exam Center or directly to the National Maritime Center. 46CFR15.401(c).

Before the vessel leaves port and all times during the voyage each lifesaving appliance must be in working order and ready for immediate use. Port side lifeboat engine does not start. 46CFR199.190(a).

Each item of lifesaving equipment with an expiration date on it must be replaced if the expiration date has passed. 3 of 6 liferaft hydrostatic release units expired. 46CFR176.808(c)

Each vessel that operates beyond 3 miles from the coastline must have a FCC type 406 EPIRB to automatically float free and activate. Marine inspector found EPIRB hydrostatic release unit expired. Replace. 46CFR180.64

At each inspection for certification, all observed unsafe practices, fire hazards and other hazardous situations must be corrected. Attending Marine Inspector found oil cans, oily rags, and open containment devices containing used oil throughout the vessel. Remove and stow properly. 46CFR176.830(a).

At each inspection for certification, spaces may be examined to see that there is no excessive accumulation of trash, debris or other matter that might create a fire hazard or block emergency escapes. Attending Marine Inspector found abundant amounts of cardboard and other debris blocking emergency escapes. Remove all debris from passageways and escape routes. 46CFR176.830(b).

At each inspection for certification the vessel must be ready for inspection of its fire protection equipment. Including all smoke and fire detection systems. Marine Inspector found missing smoke detector in mount located forward of galley 46CFR176.810 (a)(7)

An adult lifejacket must be provided for each person carried onboard. Vessel required to have 150 adult life jackets, 137 onboard. Of 137 onboard, 58 found with inoperable lights. Increase total number of adult life jackets to COI passenger count of 150 adults. Passenger count is reduced to 137 adults until attending Marine Inspector verifies presence of 150 adult life jackets. 46CFR180.71(a).

A number of child size life jackets equal to at least 10% of the persons permitted onboard must be provided. Vessel required to have a number of child life jackets equal to atleast 10% of the 150 passengers permitted onboard. Vessel found with only 14 child size life jackets. Of 14 onboard, 3 found with inoperable lights. Increase total number of child size life jackets to 15. Passenger count of children is reduced to 14 until attending Marine Inspector verifies presence of 15 child size life jackets. 46CFR180.71(b)

Before the vessel leaves port and all times during the voyage each lifesaving appliance must be in working order and ready for immediate use. Vessel’s COI requires 4 ring buoys with lights. Vessel found missing 1 lighted ring buoy. 46CFR199.190(a)

At each inspection for certification the vessel must be ready for inspection of its fire protection equipment. Including all fire detection systems. Heat detectors in engine room and emergency generator room unable to be tested – crew did not have proper equipment to test. 46CFR176.810(a)(7)

Vessel required to have the following FCC Certificates: FCC Bridge to Bridge Certificate and FCC Safety Telephone Certificate. Both found expired. Complete FCC certification and provide certificates to attending Marine Inspector. 47CFR80 / 33CFR26

Fire extinguishing equipment installed on a vessel in excess of the requirements of 181.400 must be maintained in accordance with recognized industry standard. Vessel has 2 fire pumps onboard. Fire pump designated as “Primary” found inoperable due to burst gasket seal. Fire pump designated as “Emergency Fire Pump” found operational. 46CFR181.120(a).

A vessel of 12 meters or longer in length, shall be provided with a whistle. Ship’s whistle inoperable. Replace or repair and test to satisfaction of attending Marine Inspector. 33CFR83.33(a).

At each inspection for certification, the Marine Inspector may require that an abandon ship or man overboard drill be completed. Inspection length due to expansive deficiency findings prevented execution of drills. Complete abandon ship and man overboard drill in the presence of an attending Marine Inspector. 46CFR176.808(g)

The COI renewal inspection on the MANU'ATELE was conducted on December, 2021. 6 Deficiencies discovered during this inspection remain unresolved. Rectify all deficiencies or provide documentation on why they can't be resolved by June 20, 2022. 46 CFR 176.400

Vessel life rafts are overdue for servicing. Port life boat batteries not holding charge and motor is not starting reliably. Vessel is restricted to 36 total persons on board until both issues are rectified. 46 CFR 199.45(b)(2) 46 CFR 185.730

All self-propelled vessels shall have permanently exhibited general arrangement plans for fire control stations, fire alarms, detection, sprinkler systems, extinguishers, means of escape, etc. Vessel decommissioned sprinkler system in the accommodation space, which is not required by regulation. If a lever type control is provided it must clearly indicate both the direction and amount of the rudders movement. Vessels non-follow up helm control will not move rudder and/or rudder indicator to starboard while using the #1 solenoid control. 46 CFR 58.25-35(c)

All vessels except unmanned barges shall have a bilge suction plant capable of pumping and draining any watertight compartment except for ballast, oil and water tanks. Vessel has multiple bilge suction valves that are seized. 46 CFR 56.50-50(a)(1)

Where fire extinguishing systems are installed, but not required, the system must meet the requirements of the applicable subchapter. Vessels has an automatic sprinkler system in the house that has not been serviced. Vessel must service sprinkler system or decommission to the satisfaction of the marine inspector. 46 CFR 95.01-5

At least one half of the total number of life buoys on the vessel must be fitted with a self igniting light that is approved under series 161.010. Vessel has one life buoy with a non approved light. 46 CFR 199.70(a)(3)(ii)

Any discharge of oil or oily mixtures into the sea is prohibited except when: the ship has in operation oily water separating equipment, a bilge monitor, bilge alarm, or combination thereof as required by part 155 subpart B of this chapter. Vessel could not demonstrate proper operation of OWS and could not find calibration certificate for oil content meter. Vessel must retain all oil and oily mixtures on board until proper operation of the OWS is demonstrated to the satisfaction of the marine inspector in conjuction with a current calibration certificate for the oil content meter. 33 CFR 151.10(a)(6)

Each launching mechanism must be arranged so it may be actuated by one person from a position on the vessel's deck, and except for secondary launching appliances for free-fall launching arrangements, from a position within the survival craft. The shutoff valve at the tank must be manually operable from outside the compartment in which the valve is located, preferably from an accessible position on the weather deck. Half of the emergency shut-off for the engine room fuel supply failed. Repair all valves.

It shall be the duty of the chief engineer when assuming charge of the machinery of a vessel to examine them throughly. If any parts thereof are in bad condition, the fact shall be immediately be reported to the to the master, owner or agent, and the Officer in Charge, Marine inspections. Fire detection, manual alarm, and supervised patrol systems are not required except in special cases; but if installed, the systems must meet the applicable requirements of 46 CFR, part 76 of subchapter H (Passenger Vessels) of this chapter. The activation of any detector or manual pull station must cause an audible and visual fire detection alarm signal at the control panel. Pull station in the steering compartment mounting bracket and pull station housing is broken. Repair,replace pullstation.

A vessel must carry either first-aid kit approved under approval series 160.041 or a kit with equivalent contents and instructions. First-aid kit missing on vessel. Provide first-aid kit.

A vessel must comply with the applicable requirements for any radio installations, including the requirements for a station licence and installation certificates to issued by the Federal Communications Commission, as set forth in 47 CFR part 80. The Safety Radio telephony certificate and the Bridge to Bridge Radio Certificate has expired.

As appropriate for the intended voyage, all vessels except barges, vessels operating exclusively on rivers, and motorboats other than those certificated for ocean or coast wise route, must carry adequate and up-to-date - charts, sailing directions, Coast Pilots [name withheld], notice to mariners, Tide tables, and all other nautical publications necessary. The charts, sailing directions, Coast Pilots [name withheld], notice to mariners, Tide tables are all missing on the bridge.

A marine employer whose vessel is involved in a casualty or incident that is, or is likely to become, a serious marine incident as defined in § 4.03-2 of subchapter A of this chapter shall comply with the requirements of § 4.06 in subchapter A of this chapter. The marine employer must have a sufficient number of alcohol testing devices readily accessible on board the vessel to determine the presence of alcohol in the system of each individual who was directly involved in the SMI. The marine employer must have a sufficient number of urine-specimen collection and shipping kits meeting the requirements of 49 CFR part 40 that are readily accessible for use following SMIs. Alcohol and Drug testing kits expired. Install RFI testing kits.

Each entrance to a space storing carbon dioxide cylinders, a space protected by carbon dioxide systems, or any space into which carbon dioxide might migrate must be conspicuously marked as follows: “CARBON DIOXIDE GAS CAN CAUSE INJURY OR DEATH. VENTILATE THE AREA BEFORE ENTERING. A HIGH CONCENTRATION CAN OCCUR IN THIS AREA AND CAN CAUSE SUFFOCATION.”. Space not labeled Properly label space with warning.

A survey shall be made every time an accident occurs or a defect is discovered which affects the safety of the vessel. The survey shall be such as to insure that the necessary repairs or renewal have been effectively made. Vessel sustained major damage affecting structural and watertight integrity on stbd side. Complete damage survey and submit repair proposal to the satisfaction of attending Marine Inspector.

All electrical engineering details and installations shall be in accordance with subchapter J. In addition to the emergency power sources required under part 112 of this chapter, each self-propelled vessel must have at least two electric generating sources. Vessel is required to have an emergency power source. Emergency generator was removed from the vessel for repairs. Repair or replace emergency generator to provide a sufficient emergency power source.
