However, vessel is equipped with an approved MEPC.107(49) oil content meter. MARPOL (17 CONS.) ANNEX I / REG 7.1

The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and with any additional requirements, which may be established by the company. Due to the objective evidence in the identified deficiencies, the vessel is not in substantial compliance with relevant conventions, calling into question the adequacy and implementation of the vessel’s SMS under the ISM Code. PSCOs collected objective evidence that the crew is unaware of operating key systems onboard, specifically the oily water separator. While onboard, operation of the oily water separator could not be verified to the PSCOs. Furthermore, PSCO’s observed a systematic failure of required fire and lifesaving equipment onboard the vessel. An external audit conducted by the Flag is required to determine whether the ship is operating in accordance with the ISM Code. Provide a copy of the completed audit report to USCG prior to departure from port. 74 SOLAS (20 Cons.) IX/3.1 ISM Code A/10.1

In a ship in which oil fuel is used, the arrangements for the storage, distribution and utilization of the oil fuel shall be such as to ensure the safety of the ship and persons on board. PSCOs observed excessive amounts of fuel oil and oil on the bilge tank tops and throughout the engine room, posing a fire risk to the ship and crew. 74 SOLAS (04 CONS) II-2/4.2.2

Bilge wells in periodically unattended machinery spaces shall be located and monitored in such a way that the accumulation of liquids is detected at normal angles of trim and heel, and shall be large enough to accommodate easily the normal drainage during the unattended period. All bilge alarms are found to be inoperative in the engine room. 74 SOLAS (04 CONS) II-1/48.1

In cargo ships, the failure of such gauges or over?lling of the tank shall not permit release of fuel into the space. The use of cylindrical gauge glasses is prohibited. The Administration may permit the use of oil-level gauges with ?at glasses and self-closing valves between the gauges and fuel tanks. PSCOs observed a self-closing valve between a day tank located in purifier room and the associated sight glass permanently held in the open position by safety wire. 74 SOLAS (04 CONS) II-2/4.2.2.3.5.2.2

With a periodically unattended machinery space or when only one person is required on watch, there shall be immediate water delivery from the fire main system at a suitable pressure, either by remote starting of one of the main fire pumps with remote starting from the navigation bridge and fire control station, if any, or permanent pressurization of the fire main system by one of the main fire pumps. The emergency fire pump is inoperable and main fire pump is being used for HVAC cooling and cannot sufficiently supply required pressure to fire main system. 74 SOLAS (04 CONS) II-2/10.2.1.2.2.2

The following fire protection systems shall be kept in good order so as to ensure their required performance if a fire occurs: structural fire protection, including fire-resisting divisions, and protection of openings and penetrations in these divisions. Fire doors in located on the Tween Deck in the engine room do not close properly to provide the required class boundary. Furthermore, all self-closing fire doors forming a required fire boundary within the accommodation stair well were found modified with permanently or temporarily affixed holdbacks, which are not an approved installation in accordance with the fire plan. 74 SOLAS (04 CONS) II-2/14.2.1.1.1

During preparation and launching, the survival craft, its launching appliance, and the area of water into which it is to be launched shall be adequately illuminated by lighting supplied from the emergency source of electrical power required by regulation II-1/42 or II-1/43, as appropriate. PSCOs observed inoperable emergency lighting at the davit launched liferaft and below the freefall lifeboat. 74 SOLAS (20 CONS) III/16.7

Any ship of 400 gross tonnage and above but less than 10,000 gross tonnage shall be fitted with oil filtering equipment complying with paragraph 6 of this regulation. Engineering staff, including the Chief Engineer, could not demonstrate to PSCOs proper operation of the vessel’s oil water separator, and there was no proof available that the OWS was working properly. MARPOL (2017 CONS) Annex I / Reg. 14.1

Connections within the fuel supply and spill lines shall be constructed having regard to their ability to prevent pressurized oil fuel leaks while in service and after maintenance. PSCOs discovered a high-pressure fuel line connection support bracket had a broken weld and the fuel line was supported by a rope from the overhead. Under the high-pressure fuel line, a drip pan was found with fuel oil collected from an evidential leak from the high-pressure fuel line. 74 SOLAS (04 CONS) II-2/4.2.2.5.4

Ships shall be provided with fire hoses, the number and diameter of which shall be to the satisfaction to the administration. PSCOs observed a fire hose missing from the forecastle storage in accordance with the approved fire plan. 74 SOLAS (04 CONS) II-2/10.2.3.2.1

The lines shall be painted in white or yellow on a dark ground or in black on a light ground. The marks should be plainly visible. The deck line for the vessel’s load line was undistinguishable due to being painted the same color as the hull. ILLC 8

The condition of the ship and its equipment shall be maintained to conform with the provisions present regulations to ensure that the ship in all respects will remain fit to proceed to sea without danger to the ship or persons on board. Duty PSCO was notified that vessel lost its bow thruster and that this equipment is inoperable. 74 SOLAS (20 cons.) Ch. I / Reg 11.a

All fire dampers shall be capable of manual operation. Fire damper in oil purifier room was not capable of manual operation. Ventilation can be secured but "A" Class boundary cannot be set. 74SOLAS(20)II-2/9.7.3.3

Any ship of 400 gross tonnage and above but less than 10,000 gross tonnage shall be fitted with oil filtering equipment. Oily water separator was inoperable, SMS notifications were made but neither flag or class were notified.

Before the ship leaves port and at all times during the voyage all life-saving appliances shall be in working order and ready for immediate use. Rescue boat davit brake is currently being serviced and is not operational. 74SOLAS(14) III/20.2 17ac

Every inflatable liferaft shall be serviced at intervals not to exceed 12 months, provided where in any case this is impracticable the administraion may extend this period to 17 months. Inflatable liferafts are past service date of April 2019. Vessel has no proof of extension from the administration. 74SOLAS(14)III/20.8.1 17ac

Doors in "A" Class divisions shall be so contructed as to be capable of preventing the passage of smoke and flame to the end of the one-hour standard fire test. Door sin "A" Class divisions leading to the engine room, Provision Store, and laundry space had cutouts in frame that would allow passage of smoke and flame. 74SOLAS(14)II-2/3.2.4 17ac

9900-Other (not clearly hazardous)- Each loading arm and each transfer pipe-system, including each metallic hose, must not leak under static liquid pressure at least 1.5 times the maximum allowable working pressure. Vessel has not conducted required annual pressure test of transfer pipes- 33CFR156.170(c)(4)

1671 - RADIO - THE ADMIN SHALL ENSURE THAT THE RADIO EQUIPMENT IS MAINTAINED. EPIRB BATTERY ONBOARD HAS BEEN EXPIRED SINCE DECEMBER 2016. 74SOLAS(2014 CONS) IV/15.5

0670 - LSA - AT LEAST 3 VHFS SHALL BE PROVIDED AND CONFORM TO PERFORMANCE STANDARDS. ALL 3 BATTERIES FOR VHF WERE EXPIRED. 74SOLAS(2014 CONS) III/6.2.1.1

0699 - LIFESAVING - AT LEAST ONE SART SHALL BE CARRIED ON EACH SIDE OF EACH CARGO SHIP 500 GROSS TONNAGE AND ABOVE TO CONFORM WITH STANDARDS FROM THE ORGANIZATION. BOTH SART BATTERIES ON BOARD HAVE BEEN EXPIRED SINCE DECEMBER 2016. 74SOLAS(2014 CONS) III/6.2.2

1599-To assist in casualty investigations, ships, when engaged on international voyages, shall be fitted with a voyage data recorder as follows: ships of 3,000 gross tonnage and upwards constructed on or after 01JUL2002. Vessel's VDR is giving an error message. 74SOLAS(14)Ch.V/Reg.20/1.4
