A person may not employ or engage an individual in a position required to hold an MMC unless that individual maintains a current medical certificate. MI observed vessel master [name withheld], was unable to present a valid medical certificate. Brit Cottrell is restricted from operating the vessel until he provides a valid certificate. 46 CFR 15.401(c)

Each battery used in an item of lifesaving equipment...must be replaced during the annual inspection if the expiration date of the battery has passed. MI observed the floating waterlight battery is required to be replaced every 2 years and the vessel rep stated that the current battery is approximately 3 years old. Vessel is restricted from operating at night. 46 CFR 176.700(a)

Repairs or alterations to the hull, machinery, or equipment that affect the safety of the vessel must not be made without the approval of the cognizant [name withheld] observed fractures in the welds for the rungs of the access ladder located on the port, forward side of the vessel. 46 CFR 176.700(a)

The marine employer shall ensure that all persons directly involved in a serious marine incident are chemically tested for evidence of dangerous drugs and alcohol in accordance with the requirements of 46 CFR 4.06. No alcohol test strips provided for testing within 2 hours of a serious marine incident. Provide. - 46CFR16.240

The owner/operator shall instruct each crew member, upon first being employed and prior to getting underway for the first time on a particular vessel and at least once every three months, as to the duties that the crewmember is expected to perform in an emergency including, but not limited to, the emergency instructions listed on the emergency instruction placard required by § 185.510 of this part. Crew training shall be logged for review by the Coast Guard upon request. The training entry shall include the following information: Date of the training and general description of the training topics. Initial training has never been provided. Provide updated training record to USCG. - 46CFR185.420

Employers must maintain records of chemical tests, including pre-employment and random testing, and must make these records available to Coast Guard officials upon request. Owner had no record of pre-employment or random testing. Provide record of testing from the Maritime Consortium to USCG. - 46CFR16.260(b)(1)

An EAP training program must be conducted for the employer’s crewmembers and supervisory personnel. The training program must include at least the following elements: the effects and consequences of drug and alcohol use on personal health, safety, and work environment; the manifestations and behavioral cues that may indicate drug and alcohol use and abuse; and documentation of training given to crewmembers and the employer’s supervisory personnel. Supervisory personnel must receive at least 60 minutes of training. Owner had no record of training for crewmembers or supervisor. Provide record of training to USCG. - 46CFR16.401(b)

Provide proof of required 1 hour EAP training for supervisor IAW 46 CFR 16.401.

Provide proof of last MIS submission.
