To discharge ballast water into the waters of the United Staes, the master,owner, operator, agent or person in charge of a vessel subject to 33 CFR 151.2025 must either ensure that the ballast water meets the ballast water standard in 33 CFR 151.2030(a), use an AMS as described in 33 CFR 151.2025(a)(3), or ballast with water from a U.S. public water system, according to the schedule in 33 CFR 151.2035(b). Subject vessel, of keel laid date 02DEC2014 and ballast water capacity of 33088m3, is past its compliance date per the implementation date schedule in 33 CFR 151.2035(b. Vessel is fitted with a BWTS but was not used and the vessel is actively discharging untreated ballast into U.S. waters. As the is past its compliance date, discharge of untreated ballast into U.S. waters is not permitted.

A vessel equipped with ballast water tanks that operates in the waters of the United States must maintain a ballast water water management plan that has been developed specifically for the vessel and that will allow those responsible for the plan's implementation to understand and follow the vessel's ballast water management strategy and comply with the requirments of this subpart. Vessel's ballast water management plan does not include all of the necessary provisions listed in 33 CFR 151 Subpart D.
