The machinery, boilers and other pressure vessels, associated piping systems and fittings shall be of a design and construction adequate for the service for which they are intended and shall be so installed and protected as to reduce to a minimum any danger to persons on board. Due regard being paid to moving parts, hot surfaces and other hazards. The design shall have regard to materials used in construction, the purpose for which the equipment is intended, the working conditions to which it will be subjected and the environmental unconventional arrangements. PSCO observed NO. 2 colling pump to be leaking.

The master of each vessel subject to this subpart shall employ one of the following ballast water management practices: (1) Carry out an exchange of ballast water on the waters beyond the Exclusive Economic Zone (EEZ), from an area more than 200 nautical miles from any shore, (2)Retain the vessel's ballast water on board the vessel. (3) Install and operate a BWMS that has been approved by the Coast Guard. (4) Use only water from a U.S. public water system (PWS). PSCO was notified that the vessel's Ballast Water Treatment System is inoperable and the vessel discharged untreated ballast water in port without COTP approval. 33CFR 151.1510(a)

Each ballast water management system (BWMS) manufactured under Coast Guard approval must have a nameplate which is securely fastened to the BWMS and plainly marked by the manufacturer. Vessel was unable to provide definite identification of the ballast water management system that coincided with the approval certificate. The ballast water repeat panel was marked as 162.060/14/0 while the certificate was marked as 162.060/14/2.
