99103- Other (MARPOL operational)- The master, owner, operator, agent or person in charge of a vessel equipped tih ballast tanks that operates in the waters of the United States must employ one of teh following ballast water managemetn methods: Install and operate a ballas water management system (BWMS) that has been approved by the Coast Guard under 46CFR162. The BWMS must be installed in accordance with 33CFR151.2035(b). Following installation, the master, owner, operator, agent, or person in charge of the vessel subject to this part must properly maintain the BWMS in accoradance with all manufacturer specifications. Unless otherwise expressly provided for in this subpart, the master, owner, operator, agent or person in charge of vessel employing a CG-approved BWMS must meet the applicable ballast water discharge standards found in 33CFR151.2030, at all times of discharge into the waters of the United States. PSCO observed the vessel did not use the treatment system when conducting ballast operations during the port call in Mexico or during the mid-ocean exchange. Vessel is prohibited from discharging untreated ballast water in United States Waters. 33CFR151.2025(a)(1)

99103- Other (MARPOL operational)- Maintain a ballast water managemetn (BWM) plan that has been developed specifically for the vessel and that will allow those responsible for the plan's implementation to udnerstand and follow the vessel's BWM strategy and comply with the requirements of this subpart. The plan must include actions for implementing the mandatory BWM requirements and practices. PSCO observed vessel does not have any requirements for implementing BWM while operating in United States Waters. Vessel is required to have a BWM meeting US requirements on board before discharging water in United States Waters. 33CFR151.2050(g)
