Following installation, the master, owner, operator, agent, or person in charge of the vessel must properly maintain the BWMS in accordance with all manufacturer specifications. Vessel's ballast water management system is inoperable. Vessel shall not discharge ballast water into U.S. waters. 33 CFR 151.2025(a)(1)

15101 - ISM environmental policy - Maintain a ballast water management plan that has been developed specifically for the vessel and that will allow those responsible for the plans implementation to understand and follow the vessel's BWM strategy and comply with the requirements of this subpart (33 CFR 151.2050 (g)and ISM 1.2.3). Vessel's approved (NKK) Ballast Water Management Plan does not contain any national or local requirements. Failure of the company to provide master with a U.S. addendum to the ballast water management plan had lead to vessel arriving in Houston with untreated ballast water obtained from an offshore BW exchange. BW system was inoperative at time of exchange. BW will be treated during discharge into U.S. waters. Vessel has received email authorization to discharge ballast.
