To discharge ballast water in the waters of the United States, the master, owner, operator, agent or person in charge of a vessel, subject to 33CFR151.2025 must either ensure the ballast water meets the ballast water discharge standard, use an AMS as described in 151.2025(a) or ballast exclusively with U.S. public water. AMS installed on board is inoperable and the vessel is past it required compliance date.

The company and the ship shall comply with the requirements of the International Safety Management Code. The company should establish procedures, plans and instructions, including checklists as appropriate for key shipboard operations concerning the safety of the personnel, ship and protection of the equipment. The vessel's SMS assigns work instructions as checklists for key shipboard operations. The work instruction to perform an ODME simulation test and fixed fas sampling system does not exist for this vessel. The chief officer presented a work instruction WI-TK-C414 for the ODME which was designed for a different vessel and does not provide the necessary instructions to perform a test. In addition 13 other work instructions listed for the vessel are not onboard the ship or do not exist.
