The master, owner, operator, agent or person in charge of a vessel equipped with ballast tanks that operates in the waters of the United States must employ one of the ballast water management methods. An alternate management system (AMS) that meets the requirements of 151.2026(b) of the subpart. The vessel is currently fitted with the following AMS: AMS-2014-MacGregor-AquaStar-001. During ballasting in Fos, France and subsequent empty-refill exchange in open water, the vessel failed to use the installed AMS. During PSC exam, the PSCO became aware that the vessel had discharged approximately 6,000 m3 of ballast water into the waters of the United States that had not properly been treated with the installed AMS. Vessel is prohibited from discharging any further untreated ballast water within the waters of the United States. Prior to discharging ballast water, provide updated Ballast Water Report indicating the ballast water onboard has been treated using the installed onboard AMS.

Resolution: Received class report from CHINA CLASSIFICATION SOCIETY stating all outstanding deficiencies have been rectified. The class report: (The function test of Ballast Water Management System was carried out after replacing inoperative parts.)
