The master and crew of a vessel will be familiar with the content of and have mounted at the operating station, emergency instructions containing the actions to be taken in the event of fire, heavy weather, or man overboard conditions. MI observed procedures for man overboard emergency containing irrelevant information relative to the vessel. 46 CFR 185.510 (a)

Before getting underway on a voyage or as soon as practicable thereafter, the master of a vessel shall ensure that suitable public announcements are made. MI observed crew providing pre-voyage safety brief with missing safety information. 46 CFR 185.506 (a)

Each life jacket must be marked with Type I retroreflective material approved in 46 CFR 164.018 or other standard specified by the Commandant. MI observed 09 life jackets that require replacement retroreflective tape. 46 CFR 185.604 (h)

Marine employers must establish programs for the chemical testing for dangerous drugs on a random basis of crewmembers on inspected vessels who occupy a position, or perform the duties and functions of a position required by the Certificate of Inspection. MI observed operator unable to provide current MIS report. 46 CFR 16.230 (a) (1)

Each ring life buoy with a floating waterlight must have a lanyard of at least 910 millimeters (3 feet) in length, but not more than 1,830 millimeters (6 feet), securing the waterlight around the body of the ring life buoy. MI observed floating waterlight attached to ring life buoy using lifeline. 46 CFR 180.70 (d) (2)

Each life jacket, immersion suit, and ring life buoy must be marked in clearly legible block capital letters with the vessel's name. MI observed ring life buoy without vessel name stenciled upon it. 46 CFR 185.604 (b)

All vessels must have navigation lights that are in compliance with the applicable sections of the International and Inland Navigation Rules. MI observed masthead light and anchor light operational but mounted backwards of each other. 46 CFR 183.420

46 CFR 181.520 Portable fire extinguishers must be located so that they are clearly visible and readily accessible from the space being protected. The installation and location must be to the satisfaction of the Officer in Charge, Marine Inspection. MI observed that fire extinguishers were not properly secured in stowage brackets. Vessel shall install stowage brackets to the satisfaction of USCG Marine Inspector.

46 CFR 180.78 (a) (4) If life jackets are stowed more than 7 feet above the deck, a means for quick release must be provided and must be capable of operation by a person standing on the deck. MI observed that master of vessel could not release life jackets while standing on the deck. Vessel shall enact repairs to the satisfaction of USCG Marine Inspector.

An adult life jacket must be provided for each person carried on board a vessel. MI observed 04 life jackets that were deteriorated and needed to be replaced. CODE 705: Restricted to carrying no more than 48 people that require an adult size life jacket.

46 CFR 180.71 (b) A number of child size life jackets equal to at least 10% of the number of persons permitted on board must be provided. MI observed 02 of required life jackets that were deteriorated and needed to be replaced. Life jackets were replaced on the spot.

46 CFR 176.810 (b) (1) Portable extinguishers must be inspected and maintained in accordance with NFPA 10. Monthly inspections required by NFPA 10 may be conducted by the owner, operator, person-in-charge, or a designated member of the crew. MI observed that monthly inspections were not being completed. Inspection was completed and logged.

At each initial and subsequent inspection for certification of a vessel, the owner or managing operator shall be prepared to conduct tests and have the vessel ready for inspection of lifesaving equipment and systems. Vessel was not ready for inspection.

Each officer employed on any vessel subject to this subchapter must have his or her license or merchant mariner credential (MMC) on board and available for examination at all times when the vessel is operating. Provide valid MMC of appropriate licensed mariner to operate vessel prior to continuing operations with passengers. 46 CFR 185.402

Employers must maintain records of chemical tests. Provide proof of enrollment in an approved drug and alcohol consortium for master(s) that will be operating the vessel prior to continuing operations with passengers. 46 CFR 16.620

Each vessel that operates on the high seas, or that operates beyond three miles from the coastline of the Great Lakes, must have on board a FCC Type Accepted Category 1, 406 MHz EPIRB, installed to automatically float free and activate. MI observed expired hydrostatic release. Vessel restricted to 3 NM from shore until rectified. 46 CFR 180.64

Employers must maintain records of chemical tests. MI observed missing consortium MIS report and testing results for individual crew members. 46 CFR 16.620

A vessel to which this subchapter applies may not be operated without having on board a valid U.S. Coast Guard Certificate of Inspection. Vessel was due for renewal COI inspection on 11JAN24 and has yet to receive a renewal COI inspection. 46 CFR 176.100

The construction and arrangement of a vessel must allow the safe operation of the vessel in accordance with the terms of its Certificate of Inspection giving consideration to provisions for a seaworthy hull. Vessel ran aground on 13 Aug 2022 and could not be refloated for approximately five minutes. It was undetermined which part of the hull(s) where grounded. 46 CFR 177.100

The master shall conduct sufficient drills and give sufficient instructions to make sure that all crew members are familiar with their duties during emergencies that necessitate abandoning ship or the recovery of persons who have fallen overboard. Conducted MOB drill taking approximately 15 minutes with no success in retrieving person in the water. Captain stopped all drills until more drills/training can be done. 46 CFR 185.520(a)

The master shall conduct sufficient fire drills to make sure that each crew member is familiar with his or her duties in case of a fire. Conduct satisfactory fire drill in the presence of a Coast Guard Marine Inspector. 46 CFR 185.524(a)

A vessel not required to have a power driven fire pump by § 181.300 must have at least three 9.5 liter (2 1/2 gallon) buckets, with an attached lanyard satisfactory to the cognizant OCMI. Vessel only had two buckets in satisfactory condition. Third bucket bottom was corroded through. 46 CFR 181.610

Where flexible nonmetallic hose is permitted for use in piping systems by this section, it must meet SAE J-1942 (incorporated by reference; see 46 CFR 175.600) or be specifically approved by the Commandant. Port fuel tank fill hose is severely dry-rotted and cracked. 46 CFR 182.720(e)

An adult life jacket must be provided for each person carried on board a vessel. Vessel may carry a total of 52 person including crew. Vessel had 48 Type I life jackets on board. 46 CFR 180.71(a)

A vessel must carry one floating water light, unless it is limited to daytime operation, in which case no floating water light is required. Identified incorrect battery required and expired as well. 46 CFR 180.70(d)

Electrical equipment on a vessel must be installed and maintained to: (b)Protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock. Identified electrical wiring for sewage on port side with wires exposed at fuse. 46 CFR 183.200(b)

Remote fuel shutoff stations must be marked in clearly legible letters at least 25 millimeters (1 inch) high indicating purpose of the valve and direction of operation. Remote fuel shutoff stations were not marked indicating direction of operation. 46 CFR 185.608

(a)For vessels other than those covered in paragraphs (b) and (c) of this section, the name of the vessel must be marked on some clearly visible exterior part of the port and starboard bow and the stern of the vessel. The hailing port of the vessel must be marked on some clearly visible exterior part of the stern of the vessel. (d)The markings required by paragraphs (a), (b), and (c) of this section, which may be made by the use of any means and materials which result in durable markings, must be made in clearly legible letters of the Latin alphabet or Arabic or Roman numerals not less than four inches in height. The name and hailing port on the stern of the vessel was missing multiple letters for the name and hailing port. 46 CFR 67.123(a)(d)

Emergency instructions posted at the operating station is partially missing for instructions to be carried out. 46 CFR 185.510(a)

A Certificate of Documentation is required for the operation of a vessel in certain trades, serves as evidence of vessel nationality, and permits a vessel to be subject to preferred mortgages. Certificate of Documentation was not on board when checked. The most recent Certificate of Documentation expired in 2019. Data base shows current Certificate of Documentation expiring in 2023. Provide original document. 46 CFR 67.1

The marine employer must have a sufficient number of alcohol testing devices readily accessible on board the vessel to determine the presence of alcohol in the system of each individual who was directly involved in the SMI. Alcohol test swabs were expired that are carried on board. 46 CFR 4.06-15(a)

The master of the vessel shall ensure that:(a)Each EPIRB, other than an EPIRB in an inflatable liferaft, must be tested monthly, using the integrated test circuit and output indicator, to determine that it is operative. (c)The EPIRB test required by paragraph (a) shall be logged or otherwise documented, as applicable. EPIRB had not been tested and no logs of previous monthly tests had been documented. Captain tested EPIRB and logged accordingly. 46 CFR 185.728(a)(c)

The discharge ends of fuel tank vent pipes must be fitted with removable flame screens or flame arresters. The flame screens must consist of a single screen of corrosion resistant wire of at least 30 × 30 mesh. The flame screens or flame arresters must be of such size and design as to prevent reduction in the net cross sectional area of the vent pipe and permit cleaning or renewal of the flame screens or arrester elements. Identified port fuel tank discharge vent that is obstructed by compartment next to it not allowing for proper ventilation and unable to verify screens are in place or permit them to be cleaned. Provide plan proposal to rectify. 46 CFR 182.450(e)

Each vessel that operates on the high seas, or that operates beyond three miles from the coastline of the Great Lakes, must have on board a FCC Type Accepted Category 1, 406 MHz EPIRB, installed to automatically float free and activate. EPIRB registration currently has previous Owner/Operator information. Provide current registration with proper information. **Vessel is restricted to Lakes, Bays and Sounds route** 46 CFR 180.64

46CFR182.100 All machinery and equipment must be installed and maintained in such a manner as to afford adequate protection from machinery failure. Inboard nut on port engine cracked through. Replace in kind.

Hydraulic ram on starboard engine mounted loosely to engine and causing shearing tension against mounting bolt. Re-mount ram IAW manufacturers instructions.

46CFR183.380(n) Each circuit breaker must indicate whether it is in the open or closed position. Water heater circuit breaker sheared off and unable to tell position. Replace.

Portable fuel tanks are prohibited. Vessel had portable fuel tank under bar. - 46CFR182.458(a)

Any vessel of at least five net tons which engages in coastwise trade on the navigable waters of the United States or in the Exclusive Economic Zone, must have a Certificate of Documentation bearing a valid endorsement appropriate for the activity in which engaged. Vessel's COD expired on 30NOV19. - 46CFR67.7

Each vessel that operates on the high seas, or that operates beyond three miles from the coastline of the Great Lakes, must have on board a FCC Type Accepted Category 1, 406 MHz EPIRB. Hydrostatic release for Category 1 EPIRB was never marked with expiration date. - 46CFR180.64

A vessel must carry either a first-aid kit approved under approval series 160.041 or a kit with equivalent contents and instructions. Aspirin is expired. - 46CFR184.710

Each life jacket and ring life buoy must be marked in block capital letters with the vessel's name. Ring life buoy and 10 life jackets missing vessel's name. - 46CFR185.604(b)

Each EPIRB must be tested monthly, using the integrated test circuit and output indicator, to determine that it is operative. The EPIRB test shall be logged or otherwise documented, as applicable. Owner had no record of monthly EPIRB testing for 2020. - 46CFR185.728(c)

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date tide tables, current tables, charts, and light list. Vessel could not provide current or tide tables. - 46CFR184.420(a)

The marine employer shall ensure that all persons directly involved in a serious marine incident are chemically tested for evidence of dangerous drugs and alcohol in accordance with the requirements of 46 CFR 4.06. Alcohol test strips provided by APCA used for testing within 2 hours of a serious marine incident are expired. - 46CFR16.240

Marine employers may use sponsoring organizations, or may use contractors, to conduct the random chemical testing programs required by this part. Owner had no record of current year contract with APCA. - 46CFR16.230(d)

Each EAP education program must include at least the following elements: display and distribution of informational material; display and distribution of a community service hot-line telephone number for crewmember assistance, and display and distribution of the employer’s policy regarding drug and alcohol use in the workplace. Owner had no record of signed substance abuse policy for two employees as required by program. - 46CFR16.401(a)

An EAP training program must be conducted for the employer’s crewmembers and supervisory personnel. The training program must include at least the following elements: the effects and consequences of drug and alcohol use on personal health, safety, and work environment; the manifestations and behavioral cues that may indicate drug and alcohol use and abuse; and documentation of training given to crewmembers and the employer’s supervisory personnel. Supervisory personnel must receive at least 60 minutes of training. Owner had no record of training for two crewmembers. - 46CFR16.401(b)
