NYPA’s 2019 and 2020 MIS forms were accompanied by additional federal custody and control forms. One undocumented FCCF accompanied the 2019 MIS form and four undocumented FCCF accompanied the 2020 MIS form.
Additionally, the list of covered personnel that was provided in preparation to the audit did not accurately reflect the total number of safety-sensitive employees documented on the MIS reports. A best practice for maintaining a DOT random drug testing pool is to refresh the pool to include all safety-sensitive employees subject to DOT random testing just prior to performing random selection. This will ensure an accurate random drug testing pool and exclude those not subject to DOT random testing.
Requirement: 46 CFR 16.500 and 49 CFR 40.333.
