BREAKER II

The fathometer/depth sounder was not operational and readable from the main steering station. Towing vessels must be equipped with a fathometer.

Compass deviation card was found faded and illegible. Correct magnetic compass deviation card.

The Emergency Position Indicating Radio Beacon (EPIRP) battery and hydrostatic release were expired. Installed EPIRP must have a updated battery and hydrostatic release.

FCC Radio Bridge to Bridge Radiotelephony Certificate and the Safety Radiotelephony Certificate Certificate were found to be expired. Update required FCC documents as applicable. (The Safety Radiotelephony Certificate is not currently applicable to the BREAKER II)

Draft marks were found not to be painted in a contrasting color to the hull. Repaint draft marks as necessary.

CP1- The Hyrdrostatic release unit on the vessels liferaft was not stamped with an installed date or expiration date. Vessel's owner/operator shall replace the Hydrostatic release unit with a hydrostatic release that is not expired or make changes for float free arrangment.

CP2- The Hyrdrostatic release unit on the vessels EPIRB was found to be expired. Vessel Owner/Operator shall repair or replace the unit with a unit that is not expired. Prior to operations beyonde 3 nm.

CP3- Testing of nav Safety equipment items must be recorded in the TVR, official logbook.

NYPA’s DOT/Coast Guard random drug tests were not spread reasonably throughout the calendar year.

NYPA’s written drug and alcohol policy did not provide the name(s) and contact information for the SAP(s) that may be used by NYPA for drug test violations to ensure compliance with 49 CFR 40.287.

Aspirin on board was found expired. Rectify deficiencies to the satisfaction of the attending Marine Inspector. 46 CFR 140.435

Provide an updated fire system servicing report for the vessel. 46 CFR 142.330

Vessels life raft is due for servicing, due to improper installation. Insure installation of repaired or new life raft is done in accordance with manufacturer specifications. 46 CFR 199.130 (c)

Provide documentation showing enrollment in a drug consortium that meets the requirements within USCG 46 CFR Part 16.

NYPA’s written drug and alcohol testing program included non-DOT drug and alcohol testing requirements and did not differentiate between the two distinct testing programs. Written drug and alcohol testing policy should detail an employer’s position regarding expectations of their crewmembers with regard to drug and alcohol testing and actions to take due to drug test results. If a marine employer has written policy, the written policy should be accurate and up to date.

NYPA’s 2019 and 2020 MIS forms were accompanied by additional federal custody and control forms. One undocumented FCCF accompanied the 2019 MIS form and four undocumented FCCF accompanied the 2020 MIS form. Additionally, the list of covered personnel that was provided in preparation to the audit did not accurately reflect the total number of safety-sensitive employees documented on the MIS reports. A best practice for maintaining a DOT random drug testing pool is to refresh the pool to include all safety-sensitive employees subject to DOT random testing just prior to performing random selection. This will ensure an accurate random drug testing pool and exclude those not subject to DOT random testing. Requirement: 46 CFR 16.500 and 49 CFR 40.333.

Electrical components that pose an electrical hazard must be in an enclosure. The terminals on the battery banks in the engine rooms were exposed.

Portable and semi-portable fire extinguishers must be inspected, maintained, and tested in accordance with the inspection, maintenance procedures, and hydrostatic pressure tests required by Chapters 7 and 8 of NFPA 10. Monthly maintenance has not been conducted for portable fire extinguishers.

Shut down relay for port generator failed.

Provide generator alarms and RPM gauge, on generator(s) in machinery space. Item to be completed prior to operating as ITV.
