The alcohol testing of each individual must be conducted within 2 hours of when the SMI occurred, unless precluded by safety concerns directly related to the incident. Alcohol-testing devices must be used according to the procedures specified by the manufacturer of the testing device and by this part. The alcohol testing devices on board the vessel were expired.

Each ring life buoy with a floating waterlight must have a lanyard of at least 910 millimeters (3 feet) in length, but not more than 1,830 millimeters (6 feet), securing the waterlight around the body of the ring life buoy. The floating waterlight did not have a battery or a lanyard.

The words “FIRE BUCKET” must be stenciled in a contrasting color on each bucket. The vessel did not have any fire buckets on board.
