The marine employer must have a sufficient number of alcohol testing devices readily accessible on board the vessel to determine the presence of alcohol in the system of each individual who was directly involved in the SMI. Alcohol test swabs on board were found to be expired. Replace with valid testing device.

The words “FIRE BUCKET” must be stenciled in a contrasting color on each bucket. Fire buckets did not have labeling.

Rails on passenger decks of a ferry or a vessel engaged in excursion trips, including but not limited to sightseeing trips, dinner and party cruises, and overnight cruises, must be at least 1,000 millimeters (39.5 inches) high and must be spaced at intervals of not more than 100 millimeters (4 inches).

A vessel that is exposed to salt water more than three months in any 12 month period since the last examination must undergo a drydock examination and an internal structural at least once every two years. Vessel owner/operator failed to complete pressure test of pontoons and complete drydock exam. Schedule and complete drydock exam.

Each item of lifesaving equipment with an expiration date on it must be replaced if the expiration date has passed. Marine Inspector found battery in the vessel's ring buoy attached light to be expired. Replace.

Marine employers shall establish programs for the chemical testing for dangerous drugs on a random basis of crew members on inspected vessel's. Marine Inspector found drug program enrollment not current on vessel. Provide current documentation to the satisfaction of the Coast Guard.

Marine employers shall establish programs for the chemical testing for dangerous drugs on a random basis of crew members on inspected vessels who: (1) Occupy a position, or perform the duties and functions of a position, required by the vessel's Certificate of Inspection; (2) Perform the duties and functions of patrolmen or watchmen required by this chapter; or, (3) Are specifically assigned the duties of warning, mustering, assembling, assisting, or controlling the movement of passengers during emergencies. Marine employers may form or otherwise use sponsoring organizations, or may use contractors, to conduct the random chemical testing programs required by this part. Neither the captain nor the deckhand were enrolled in a drug testing program meeting the requirements of this part.

Except on a vessel limited to daytime operations, the compass must be illuminated. Vessel is limited to daylight operations only until an illuminated compass is provided.

Every vessel subject to Part III of Title III of the Communications Act must have a detailed inspection of the radio installation by an FCC-licensed technician in accordance with §80.59 once every five years. If the ship passes the inspection, the technician will issue a Communications Act Safety Radiotelephony Certificate. Vessel is limited to operations within 1000 feet of shore until it can provide a Safety Radiotelephony Certificate.

Each ship transporting more than six passengers for hire equipped with a radiotelephone station in accordance with Part III of Title III of the Communications Act must carry a radio operator who meets the following requirements: (1) Where the station power does not exceed 250 watts carrier power or 1500 watts peak envelope power, the radio operator must hold a marine radio operator permit or higher class license. (2) Where the station power exceeds 250 watts carrier power or 1500 watts peak envelope power, the radio operator must hold a general radiotelephone operator license or higher class license. Vessel is limited to operation within 1000' from shore until the captain or crew can provide a valid radio operator permit.

All cable and wire must: Be installed with metal supports spaced not more than 610 millimeters (24 inches) apart, and in such a manner as to avoid chafing and other damage. The use of plastic tie wraps must be limited to bundling or retention of multiple cable installations, and not used as a means of support, except that on vessels of not more than 19.8 meters (65 feet) in length, installations in accordance with paragraph 14.h of ABYC E–8 and paragraph 15.h of ABYC E–9 (both incorporated by reference; see 46 CFR 175.600) are acceptable as meeting the requirements of this section. Cables run under console were not supported.

Each ring life buoy on a vessel must be approved in accordance with 160.050 in Subchapter Q. Vessel's ring life buoy in non working condition.

Each vessel must be equipped with at least two operable portable battery lights. Vessel missing one portable light.
