The operation of a marine diesel engine that is installed on a ship constructed on or after 01JAN2016 is prohibited except when the emission of nitrogen oxides from the engine is within the requirements set forth in 13.5.1.1. Due to a malfunction of the vessels scrubber, the engines were only able to operate as a tier II when required to be a tier III. Vessel must undergo repairs prior to entering the North American ECA after sailing foreign. MARPOL Annex VI/13.5.1
