A vessel must comply with the structural design requirements of one of the standards listed. There was a fracture in the deck near the starboard side aft stanchion. Repair the fracture.

Every vessel subject to Part III of Title III of the Communications Act must have a detailed inspection of the radio installation by an FCC-licensed technician in accordance with § 80.59 once every five years. The FCC-licensed technician must use the latest FCC Information Bulletin, How to Conduct an Inspection of a Small Passenger Vessel. If the ship passes the inspection, the technician will issue a Communications Act Safety Radiotelephony Certificate. Communications Act Radiotelephony Certificates may be obtained from the Commission's National Call Center—[phone withheld]—or from its forms contractor. The FCC Communications Act Radiotelephony Certificate expired in January 2025. Vessel is restricted to operate at not more than 1,000 feet from any shore. 47 CFR 80.903, 46 CFR 184.502.

A vessel must carry adequate and up-to-date publications as required by 46 CFR 184.420. Vessel is missing an updated version of the following publications: a. U.S. Coast Pilot or similar publication; b. Coast Guard Light List; c. Tide tables. 46 CFR 184.420.

The master of a vessel, except a vessel listed in § 185.502(a) of this part, shall keep a correct, written count of all passengers that embark on and disembark from the vessel. Prior to departing on a voyage, the passenger count must be communicated verbally or in writing, and available ashore at the vessel's normal berthing location or with a representative of the owner or managing operator of the vessel. The passenger count shall be available to the Coast Guard upon request. Vessel was found not having records of conducting passenger counts. Passenger counts will be reviewed after 14 days by an attending USCG Marine Inspector. 46 CFR 185.504.

The master and crew of a vessel will be familiar with the content of and have mounted at the operating station, emergency instructions containing the actions to be taken in the event of fire, heavy weather, or man overboard conditions. Emergency instructions shall be mounted at the operating station, visible to passengers and crew. 46 CFR 185.510.

The marine employer must have a sufficient number of alcohol testing devices readily accessible on board the vessel to determine the presence of alcohol in the system of each individual who was directly involved in the SMI. The alcohol testing devices need not be carried on board each vessel if obtaining the devices and conducting the required alcohol tests can be accomplished within 2 hours from the time of occurrence of the SMI. Vessel owner/operator did not provided any alcohol testing device on board. 46 CFR 4.06-15 46 CFR 185.212

Employee Assistance Program must include training on drug use for marine employer's supervisory personnel and display and distribution of informational material; display and distribution of a community service hot-line telephone number for crewmember assistance, and display and distribution of the employer's policy regarding drug and alcohol use in the workplace. (b) Training must be conducted for the employer's crewmembers and supervisory personnel in the effects and consequences of drug and alcohol use on personal health, safety, and work environment; the manifestations and behavioral cues that may indicate drug and alcohol use and abuse; and documentation of training given to crewmembers and the employer's supervisory personnel. Supervisory personnel must receive at least 60 minutes of training. 1. Employee Assistance Program Placard was found expired dated YR2024. 2. Provide evidence to the USCG Marine Inspector of vessel Captain of 60 minutes training, provided by the Maritime Consortium, as required in 46 CFR 16.401 (b), (Employee Assistance Program). 46 CFR 16.401

The master shall conduct sufficient fire drills to make sure that each crew member is familiar with his or her duties in case of a fire, man overboard and passenger egress drills. drills must be logged or otherwise documented for review by the Coast Guard upon request. The drill entry must include the following information: (1) Date and time of the drill; and (2) General description of the drill scenario and topics. Drills were conducted, but lacked of detailed information as required. 46 CFR 185.524, 46 CFR 185.507

EAP education program: Each EAP education program must include at least the following elements: display and distribution of informational material; display and distribution of a community service hot-line telephone number for crewmember assistance, and display and distribution of the employer's policy regarding drug and alcohol use in the workplace. EAP Placard was found expired.

Connections and terminations to all conductors must retain the original electrical, mechanical, flame-retarding, and, where necessary, fire-resisting properties of the cable. All connecting devices must be suitable for copper stranded conductors. The connections must be made within an enclosure and the insulated cap of the connector must be secured. Dead end wires found beneath center console operating station, aft light, and connections to sound system above and around operating station.

An adult life jacket must be provided for each person carried on board a vessel. All adult life jackets reflective tape are damaged. Replace in kind and ensure life jackets are stored in dry storage. 46 CFR 180.71 (a)/Code 17.

The owner or managing operator must provide satisfactory evidence of the required servicing to the marine inspector. Vessel's fire extinguishers did not have servicing done. Have fire extinguishers serviced by approved servicing facility. 46 CFR 176.810 (b)(iv)Code 17.

Each life jacket, immersion suit, and ring life buoy must be marked in clearly legible block capital letters with the vessel's name. The marking is not required on a life jacket carried to meet a temporary need for additional life jackets, if the life jacket has the name of another vessel or company marked on it. For an immersion suit, the name of the person to whom the immersion suit is assigned is an acceptable alternative to the name of the vessel. New children lifejackets on-board were not labeled. Vessel name on life ring was damaged and unreadable. Label as required. 46CFR 185.604(b), Code 16C.

A vessel must carry one floating waterlight, unless it is limited to daytime operation, in which case no floating waterlight is required. Each floating waterlight installed after March 11, 1997, on a vessel carrying only one ring buoy, must be attached to the lanyard with a corrosion-resistant clip. Life ring's floating waterlight battery was expired. Replace in kind or replace waterlight with approved kind. 46CFR180.70 (d)/16C.

Each hydrostatic release unit, other than a disposable unit, must be serviced. EPIRB hydrostatic release unit was expired. Replace in kind. 46 CFR 185.740/Code 16C.

A vessel on an oceans, coastwise, limited coastwise, or Great Lakes route must carry—(1) Six hand red flare distress signals approved in accordance with § 160.021 in subchapter Q of this chapter and(2) Six hand orange smoke distress signals approved in accordance with § 160.037 in subchapter Q of this chapter. Vessel did not have the appropriate amount needed for a limited coastwise route. Ensure appropriate amount is store in watertight container. 46CFR 180.68(a)/Code 16C.

Portable watertight containers for distress flares and smoke signals shall be of a bright color, and containers shall be clearly marked in legible contrasting letters at least 12.7 millimeters (0.5 inches) high: “DISTRESS SIGNALS”. Storage box for flares is not labeled. Label as required. 46 CFR 185.614/ Code 16 C.

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date:Charts of large enough scale to make safe navigation possible. Vessel's chart are not updated or too small to be readable. Provide updated chart of operating area. 46 CFR 184.420 (a) (1)/ Code 16C.

Marine employers shall establish programs for the chemical testing for dangerous drugs on a random basis of crewmembers on inspected vessels. The current Maritime Consortium certificate expired on 31December2022.

To qualify for a medical certificate, a mariner must provide evidence of meeting the medical and physical standards in this section on a CG-719-K or CG-719-K/E, as appropriate. The current medical certificate expired in 2020 and is no longer valid.

At each inspection for certification and at every other vessel inspection all observed unsafe practices and fire hazards must be corrected and all required protective devices must be in satisfactory condition. No straps were observed to secure both portable gas tanks in place.

Each EPIRB must be tested monthly to determine that it is operative and the test shall be logged. The last EPIRB test was conducted Nov 2022 and tests were not being completed monthly prior to that date.

Placards containing instructions for the donning and use of the life jackets aboard the vessel must be posted in conspicuous places that are regularly accessible and visible to the crew and passengers. The currently posted instructions differ from the life jackets provided on board.

A submersible electric bilge pump may be used as a power bilge pump provided that the pump is listed by an independent laboratory as meeting the requirements in UL 1113. The currently installed submersible electric bilge pump does not meet the UL standard.

Portable fire extinguishers must be located so that they are clearly visible and readily accessible from the space being protected. The installation and location must be to the satisfaction of the Officer in Charge, Marine Inspections. The 2 required extinguishers were not mounted or secured.

Each item of lifesaving equipment determined by the marine inspector to not be in serviceable condition must be repaired or replaced. The retro-reflective material on 04 child life jackets was damaged and requires replacement. 46 CFR 176.808 (b)

A vessel must be provided with bilge pumps in accordance with Table 182.520(a). Vessels carrying not more than 49 passengers, 26 ft to 65 ft shall have 01 fixed power pump and 01 portable hand pump. Vessel did not have 01 portable hand pump on board. 46 CFR 182.520 (a)

Vessel VHF radio was found not to be broadcasting during radio test. Prove proper operation of VHF Marine Radio for the satisfaction of an attending U.S. Coast Guard Inspector. Vessel is restricted to operate not more than 1,000 feet from any shore. 46 CFR 184.502/ 47CFR part 80.

Every vessel must be fitted with a suitable magnetic compass designed for marine use, to be mounted at the operating station. The magnetic compass was found to have at least 60 degrees difference. Prove proper operation of magnetic marine compass. 46 CFR 184.402.

A vessel must carry either a first aid kit approved under the approval series 160.041 or a kit with equivalent contents and instructions. Vessel first aid kit was found to have expired medications. Provide and approved type first aid kit or replace with equivalent contents as required by 160.041. 46 CFR 184.710.

Each vessel must be equipped with at least two operable portable battery lights. Vessel was found to have only one working portable light. Provide at least two working portable lights. 46 CFR 183.432.

Life ring water light was found to have an expired battery. Install a new current dated water light battery. 46 CFR 180.70 (6)(d).

The master shall conduct sufficient drills and log them in the drills log. Drills log was found to have no evidence of drills being logged after being conducted. Drills must be logged by entering the date of the drill and a general description of the drill scenario.

Master shall ensure that the EPIRB must be tested monthly and test is required to be logged or otherwise documented. The EPIRB was not being tested or testing was being logged, nor documented. Test EPIRB on a monthly basis and record the test either in documents or a log. 46 CFR 185.728 (a) (c).

Lifering was found to have missing letter of the vessel name. Provide missing vessel name on the lifering. 46 CFR 180.70.

Code 01201: Operation of transmitters of any ship must be performed by a person holding a commercial radio operator license; vessel licenses captain must have a valid FCC Marine Radio Operator Permit. 46CFR184.502

Code 04109: The master shall conduct sufficient drills and give sufficient instructions to make sure that all crew members are familiar with their duties during emergencies; conduct safety drills in the presence of a USCG Marine Inspector. 46CFR185.250

Code 18299: Employers must ensure that all their crew members meet the required chemical testing program and mandated training. Provide proof of a drug and alcohol program enrollment for all crew members and proof that the have completed the mandated training. 46CFR4.06

Code 10124: Portable water containers for distress flares and smoke signals shall be of a bright color and containers shall be clearly marked in legible contrasting letters at least 0.5 inches high: "DISTRESS SIGNALS". Provide vessel with a distress signals containers. 46CFR185.614

Code 07199: A vessel not required to have a fire power driven pump by 46 CFR 181.300, must have at least three 2.5 gallons buckets, with an attached lanyard, placed so as to be easily available during an emergency. The words "FIRE BUCKET" must be stenciled in a contrasting color on each bucket. Provide vessel with three fire buckets as required by regulation. 46CFR 181.610

No person may use a vessel equipped with propulsion machinery on waters subject to U.S. jurisdiction unless it has a number issued on a certificate of number by the issuing authority in the state of principal operation; provide proof of vessel registration.

The movement of a vessel shall be under the direction and control of the Master or Licensed Mate, each officer employed on any vessel subject to sub-chapter T must have his or her license or merchant mariner credential on-board and available for examination at all times when the vessel is operating; provide proof of Master's license.

Operation of transmitters of any ship station must be performed by a person holding a commercial radio operator license; provide proof of FCC Operator Permit.

Stations in the maritime service must be licensed by the FCC; provide proof of FCC Station License.

Crew training and drills shall be logged or otherwise documented for review by USCG upon request; provide the vessel with a logbook for documentation purposes.

Before getting underway on a voyage or as soon as practicable thereafter, the master of a vessel shall ensure that suitable passenger safety announcements are made; provide evidence of a satisfactory passenger safety orientation.

Employers must ensure that they and their crewmembers meet the requirements of the required chemical testing program; provide proof of chemical testing program.

A vessel must carry a first-aid kit approved under approval series 160.041 or a kit with equivalent contents and instructions; provide the vessel with an approved first-aid kit.

Each life jacket must be marked in clearly legibly block capital letters with the vessel's name; properly mark the life jackets as required.
