A vessel of at least 7.9 meters (26 feet) in length must be provided with individual bilge lines and bilge suctions for each watertight compartment, except that the space forward of the collision bulkhead need not be fitted with a bilge suction line when the arrangement of the vessel is such that ordinary leakage may be removed from this compartment by the use of a hand portable bilge pump or other equipment, and such equipment is provided. VSL's bilge suction line was broken flooding the engine room and rendering system inoperable.

The materials and construction of fuel lines, including pipe, tube, and hose, must comply with the requirements of this paragraph.(1) Fuel lines must be annealed tubing of copper, nickel-copper, or copper-nickel having a minimum wall thickness of 0.9 millimeters (0.035 inch) except that:(i) Diesel fuel piping of other materials, such as seamless steel pipe or tubing, which provide equivalent safety may be used;(ii) Diesel fuel piping of aluminum is acceptable on aluminum hull vessels provided it is a minimum of Schedule 80 wall thickness; and(iii) when used, flexible hose must meet the requirements of § 182. Fuel line from tank to engine room in steering gear room has excessive wear and corrosion.

The AIS must be maintained in effective operating condition, which includes the accurate input and upkeep of all AIS data fields and system updates. Although the vessel is not required to have AIS, it is equipped with a Class B device and is erroneously indicating it is a pleasure craft instead of a passenger vessel. The crew were unable to change the vessel type during the inspection. 33 CFR 164.46(d)(2)
