The master, owner, operator, agent, or person in charge of a vessel equipped with ballast tanks that operates in the waters of the United States must employ one of the authorized ballast water management methods listed in 33 CFR 151.2025(a). Vessel’s ballast water management system is inoperable. Vessel has been granted an extraordinary circumstance to employ the ballast water management method listed in 33 CFR 151.2025(a)(3) to conduct cargo operations while in the Sector New Orleans COTP Zone. In accordance with 33 CFR 151.2040(b)(3), the vessel must discharge only that amount of ballast water operationally necessary to ensure the safety and stability of the vessel for cargo operations. 33 CFR 151.2025(a), Rectify Deficiency Prior to next U.S. Port after sailing foreign, Code 40.

Subject to regulation 3 of MARPOL Annex VI, in an emission control area designated for Tier III NOx control under paragraph 6 of MARPOL Annex VI/13, the operation of a marine diesel engine that is installed on a ship is prohibited except when the emission of nitrogen oxides from the engine is within the limits listed in MARPOL Annex VI/5.1.1.1.1-.3 when that ship is constructed on or after 01 January 2016 and is operating in the North American Emission Control Area (ECA).
Air compressor used for air supply for the main and auxiliary engines selective catalytic reduction system for operation in Tier III mode is inoperable. Vessel is only capable of maintaining Tier II mode in regards in NOx emissions while operating in the North American ECA.
