Port State Control Officers (PSCO) have established clear grounds and obtained supporting information indicating that this vessel discharged prohibited garbage into the sea during transit to its current port.

In accordance with MARPOL Annex V, all discharges of garbage into the sea must be promptly recorded in the Garbage Record Book and signed by the officer in charge on the date of the discharge. Port State Control Officers (PSCO) obtained objective evidence that the vessel's crew illicitly discharged prohibited garbage, specifically red and black metal drums, into the sea while en route to New Haven, CT. The Garbage Record Book presented to the Coast Guard during the examination contained no entries reflecting this disposal, rendering the official record false and failing to accurately document the vessel's waste management operations.

The Company must ensure that its safety and environmental protection policy is implemented and maintained at all levels of the organization, both ship-based and shore-based. During an expanded MARPOL examination conducted on this date, objective evidence revealed a systemic failure to fully implement the requirements of the vessel's Safety Management System (SMS). Based on continuous objective evidence gathered during the examination, the Company is failing to ensure that critical environmental policies are being executed on-board. Due to this breakdown in the SMS, an external audit of the vessel's Safety Management System is required prior to release from detention.
