The Company should establish procedures, plans and instructions, including checklists as appropriate, for key shipboard operations concerning the safety of the personnel, ship and protection of the environment."
PSCO's were informed that the ships crew was unaware of the procedures for treating ballast water upon intake, resulting in the discharge of untreated ballast water in US waters. An ISM audit is required to clear the deficiency. - 74 SOLAS (20) IX/3.1 - ISM Code Part A / 7 - 40ac

...Following installation, the master, owner, operator, agent, or person in charge of the vessel subject to this subpart must properly maintain the BWMS in accordance with all manufacturer specifications."

PSCOs identified that the vessel submitted an NBIC form listing that onboard treatment was conducted, but upon investigation learned that the ballast water was not treated on intake. - 33CFR151.2060(c)(5) - 40c
