THE COMPANY AND THE SHIP SHALL COMPLY WITH THE REQUIREMENTS THE INTERNATIONAL SAFETY MANAGEMENT CODE. FOR THE PURPOSE OF THIS REGULATION, THE REQUIREMENTS OF THE CODE SHALL BE TREATED AS MANDATORY.
(6.4) THE COMPANY SHOULD ENSURE THAT ALL PERSONNEL INVOLVED IN THE COMPANY'S SAFETY MANAGEMENT SYSTEM HAVE AN ADEQUATE UNDERSTANDING OF RELEVANT RULES, REGULATIONS, CODES, AND GUIDELINES.
(9.1) THE SAFETY MANAGEMENT SYSTEM SHOULD INCLUDE PROCEDURES ENSURING THAT NON-CONFORMITIES, ACCIDENTS, AND HAZARDOUS SITUATIONS ARE REPORTED TO THE COMPANY, INVESTIGATED AND ANAYLYZED WITH THE OBJECTIVE OF IMPROVING SAFETY AND POLLUTION PREVENTION. DEFICIENCIES 1 AND 2 PROVIDE OBJECTIVE EVIDENCE OF A SERIOUS FAILURE OF THE IMPLEMENTATION OF THE ISM CODE. FOR THE PURPOSE OF THIS REGULATION, THE REQUIREMENTS OF THE CODE SHALL BE TREATED AS MANDATORY. IN MEETING THESE REQUIREMENTS, THE COMPANY SHOULD ENSURE THAT INSPECTIONS ARE HELD AT APPROPRIATE INTERVALS. EACH COMPANY VESSEL IS SUPPLIED WITH GAS MONITORING EQUIPMENT TO BE USED WHEN TESTING THE ATMOSPHERE WITHIN A DANGEROUS SPACE. IN ADDITION, THE MONITOR SHOULD BE ZERO CALIBRATED AND SPAN CHECKED EVERY TWO WEEKS. UPON REVIEWING PORTABLE GAS METER TEST LOGS, PSCO IDENTIFIED A LACK OF KNOWLEDGE FROM VESSEL'S CREW PERTAINING TO THE BI-WEEKLY SPAN GAS TEST REQUIRED AS PER THE SAFETY MANAGEMENT SYSTEM (SMS). THE CREW WAS UNABLE TO PROVIDE AN EFFECTIVE SPAN GAS TEST WITHOUT USCG ASSISTANCE.
