The provisions of Part III of Title III of the Communication Act require United States vessels which transport more than six passengers for hire while such vessels are being navigated on any tidewater within the jurisdiction of the United States adjacent or contiguous to the open sea, or in the open sea to carry a radiotelephone installation complying with this subpart. The provisions of Part III do not apply to vessels which are equipped with a radio installation for compliance with Part II of Title III of the Act, or for compliance with the Safety Convention, or to vessels navigating on the Great Lakes. Vessel does not have a radiotelephony certificate on board. 47 CFR 80.901

The master of the vessel shall ensure that: (a) Each EPIRB, other than an EPIRB in an inflatable liferaft, must be tested monthly, using the integrated test circuit and output indicator, to determine that it is operative; (c) The EPIRB test required by paragraph (a) shall be logged or otherwise documented, as applicable. Provide logs of monthly EPIRB test for June, July and August 2025. 46 CFR 185.728 (a)(c)

The operating gear for the shutoff valves at the tanks shall be accessible at all times and shall be suitably marked. Label diesel tank heater valve "fuel shut off."

A vessel must carry either a first-aid kit approved under ISO 18813:2006(E) paragraph 4.12 for contents and instructions. List inventory of first-aid kit contents.

As appropriate for the intended voyage, a vessel must carry adequate and up-to-date: (1) Charts of large enough scale to make safe navigation possible; (2) U.S. Coast Pilot or similar publication; (3) Coast Guard Light List; (4) Tide tables; and (5) Current tables, or a river current publication issued by the U.S. Army Corps of Engineers or a river authority.

No marine employer shall engage or employ any individual to serve as a crewmember unless the individual passes a chemical test for dangerous drugs for that employer. Provide testing results for the deckhand on board and enroll deckhand in the consortium. Until then, deckhand cannot fill a safety sensitive position.

All fuel tanks must be electrically bonded to a common ground. Ground fuel fill hose.

Each battery must be located as high above the bilge as practicable, secured to protect against shifting with the roll and pitch of the vessel, and free from exposure to water splash or spray. Secure port hull tunnel battery.

The master of the vessel shall ensure that the monthly EPIRB test is logged. The inspection and maintenance of the survival craft shall be logged. The owner or managing operator or a qualified servicing facility must conduct the following inspections: portable extinguishers must be inspected monthly required by NFPA. Above-mentioned monthly logs were missing. Provide July and August log entries for review by the Coast Guard. 46 CFR 185.728(c); 46 CFR 185.702; 46 CFR 176.810(b)(1)

The stability letter must be posted under glass or other suitable transparent material, such that all pages are visible, at the operating station of the vessel. Stability letter was not posted. Post stability letter.

The master and crew of a vessel will be familiar with the content of and have mounted at the operating station, emergency instructions containing the actions to be taken in the event of fire, heavy weather, or man overboard conditions. Emergency instructions were posted in the passenger accommodation space but not at the operating station. Post instructions at the operating station.

Each disposable hydrostatic release unit must be marked with an expiration date of two years after the date on which the unit is installed. EPIRB hydrostatic release unit was expired at the time of inspection.

Fuel piping separated by hose which is a nonconductor must be joined by a conductor for protection against generation of a static charge when filling with fuel. The fuel fills both port and stbd are missing the bonding wires. 46 CFR 182.445(g)

In accordance with the vessels stability letter the upper deck is limited to no more than 16 passengers. A durable marking of at least x1 inch showing the max passengers allowed must be posted at the entry way to the upper deck. 46 CFR 185.602(g)

All escape hatches and other emergency exits used as a means of escape must be marked on both sides. "EMERGENCY EXIT, KEEP CLEAR" At least 2" high. Crew berthing emergency escapes are not labeled on the outside. Label both sides of crew berth, escape hatches prior to allowing crew to use berthing areas.
