Subject to regulation 3 of this annex, in an emission control area designated for TIER III NOx control under paragraph 6 of this regulation, the operation of a marine diesel engine that is installed on a ship is prohibited except when the emission of nitrogen oxides from the engine is within TIER III limits when operating in the North American Emission Control Area or the United States Caribbean Sea Emission Control Area. The vessel's Selective Catalytic Reduction system for the Main Engine, used for NOx emissions is unable to start, due to inoperable control valves for Urea Control Consumption. Due to this malfunction the vessel is not capable of operating its Main Engine within TIER III limits.
