A marine employer shall comply with the requirements of § 4.06 in subchapter A of this chapter - The marine employer must have a sufficient number of alcohol testing devices readily accessible on board the vessel to determine the presence of alcohol in the system of each individual who was directly involved in the SMI. MI observed testing devices not present at time of inspection. Required to provide evidence of devices. 46 CFR 185.212; 701c

A marine employer shall comply with the requirements of § 4.06 in subchapter A of this chapter - A consortium or other employer representative may submit data for a marine employer. Reports may contain data for more than one marine employer. Each report, however, must list the marine employers included in the report. MI observed Management Information System (MIS) report not available to confirm submission. Required to provide proof of submission. 46 CFR 185.212; 16c

Monthly inspections required by NFPA 10 may be conducted by the owner, operator, person-in-charge, or a designated member of the crew. MI observed operator unable to furnish records of monthly inspections conducted on portable extinguishers. Required to provide logs for maintaining portable extinguishers. 46 CFR 176.810(b)(ii); 16c

Portable fire extinguishers must be located so that they are clearly visible and readily accessible from the space being protected. The installation and location must be to the satisfaction of the Officer in Charge, Marine Inspection. MI observed broken bracket on STBD bow portable fire extinguishers mount. Repair/replace. 46 CFR 181.520; 16c

Electrical equipment on a vessel must be installed and maintained to protect passengers, crew, other persons, and the vessel from electrical hazards, including fire, caused by or originating in electrical equipment, and electrical shock. MI observed multiple open ended wire terminations. Required to properly terminate wires or remove if no longer in use. 46 CFR 183.200(b); 16c

All vessels must have navigation lights that are in compliance with the International and Inland Navigation Rules. MI observed incorrect arc of visibility on all round white light. Restricted to day light/fair weather ops. 46 CFR 183.420; 705c

Vessel must undergo an annual inspection as specified in paragraph (b)(1) of this section. Vessel must undergo an annual inspection within 3 months before or after the each anniversary date. Vessels anniversary date was April 25th, 2025, and vessel is past 3 months from said date. Vessel shall not operate with passengers until an annual inspection has been complete. 46 CFR 176.500 (b)(1)

Remote fuel shutoff stations must be marked in at least 1-inch letters indicating purpose of the valve and direction of operation. Vessel does not have the fuel shut off valves marked. 46CFR185.610

A vessel that is exposed to salt water more than three months in any 12 month period since the last examination must undergo a drydock examination and an internal structural at least once every two years. Vessel was due for credit drydock examination on 31OCT23 and has yet to receive a credit drydock exam. 46 CFR 176.600(c)(1)

Remote fuel shutoff stations must be marked in clearly legible letters at least 1 inch high indicating purpose of the valve and direction of operation. MI observed no fuel shutoff valve markings onboard. 46 CFR 185.608

Fire fighting drills and training shall be logged or otherwise documented for review by the Coast Guard upon request. MI observed no logged fire fighting drills nor training. 46 CFR 185.524(d)

Each battery without an expiration date indicated on it or for which the owner or managing operator does not have a record of the expiration date, used in an item of lifesaving equipment, must be replaced during the annual inspection. MI observed that the floating waterlight for the ring life buoy was marked that batteries must be replaced annually. Vessel representative stated that he had never changed the batteries, and the waterlight had been installed for more than a year. Vessel is restricted to daylight operations only. 46 CFR 185.726(e)

Remote fuel shutoff stations must be marked in clearly legible letters at least 1 inch high indicating purpose of the valves and direction of operation. Vessel's fuel shutoff valves are located down line of the fuel filters. Shutoff valves were not labeled. 46 CFR 182.455 (b)(4) 46 CFR 185.608 705: Fix within 2 days

A vessel must carry one floating water light, unless it is limited to day-time operations. The water light did not have a battery installed. Vessel is limited to day-time operations until light is operational. 46 CFR 180.70 (d) 705: Fix within 7 days

Each floating water light installed on a vessel carrying only one life buoy, must be attached to the lanyard with a corrosion resistant clip. Water light did not have a clip for the attached line. 46 CFR 180.70(d)(3) 705: Fix within 7 days

A vessel must comply with the applicable requirements for any radio installations for a station license and installation certificates to be issued by the Federal Communications Commission, as set forth in 47 CFR part 80. Vessel did not have a Safety Radio Certificate or Station License. 46 CFR 184.502 705: Fix within 7 days

Every vessel must be fitted with a suitable magnetic compass designed for marine use. It must be illuminated if vessel operates at night. Vessel did not have a magnetic compass installed. 46 CFR 184.402(a) 705: Fix within 7 days

Operation of transmitters of any ship station must be performed by a person holding a commercial radio operator license or permit of the class required below. The operator is responsible for the proper operation of the station. Master did not have operators license on board. Provide proof of a valid operators license with in 7 days. 47 CFR 80.155

The drills required by § 185.524, including fire location and fire type; and (3) Emergency egress training for each member of the crew, to occur for all members of the crew - (i) At least monthly while such members are employed on board the vessels; and (ii) Each time a crew member joins the crew of such vessel. Crew training shall be logged or otherwise documented for review by the Coast Guard upon request. The training entry shall include the following information. (1) Date of the training; and (2) General description of the training topics. Vessel did not have drills logged. 46 CFR 185.420(b)(2) + 46 CFR 185.420(c) 705: Fix within 7 days

Each EAP education program must include at least the following elements: display and distribution of informational material; display and distribution of a community service hot-line telephone number for crewmember assistance, and display and distribution of the employer's policy regarding drug and alcohol use in the workplace. Vessel did not have EAP information displayed. 46 CFR 16.401(a) 705: Fix within 7 days

A ship, except a ship of less than 26 feet in length, must have a placard of at least 5 by 8 inches, made of durable material fixed in a conspicuous place in each machinery space, or at the bilge and ballast pump control station, stating the following: Discharge of Oil Prohibited. Vessel did not have required placards on board. 33 CFR 155.450(a) 705: Fix within 7 days.

At a minimum, each placard must notify the reader of the operating requirements contained in §§ 151.67 through 151.73 as they apply to that ship. The following requirements should also be prominently stated: (1) The discharge of all garbage is prohibited into the navigable waters of the United States and into all other waters. Vessel did not have garbage placards on board. 33 CFR 151.59(c) 705: Fix Within 7 days

This vessel cannot carry passengers until it has completed the attached work-list, been re-inspected by Marine Inspectors assigned to the local cognizant OCMI in the vessel’s intended area of operation and issued a full-term Certificate of Inspection with conditions of operation.
