Before the ship leaves port and at all times during the voyage, all life-saving appliances shall be in working order and ready for immediate use. PSCO observed all life raft hydrostatic releases not properly connected. 74 SOLAS(97) III/19.2

The following fire protection systems shall be kept in good order so as to ensure their required performance if a fire occurs fire detection and fire alarm systems; PSCO observed a missing smoke detector in the cargo deck and a covered smoke detector in the engine room flat. 74 SOLAS(20) II-2/2.1

The condition of the ship and its equipment shall be maintained to conform with the provisions of the present regulations to ensure that the ship in all respect will remain fit to proceed to sea without danger to the ship or persons onboard. PSCO observed that the MDE water expansion tank sight glass was replaced with clear plexi-glass tube and the securing nut at the bottom of the sight glass was broken 74 SOLAS(20) I/11

The machinery, boilers and other pressure vessels, associated piping systems and fittings shall be of a design and construction adequate for the service for which they are intended and shall be so installed and protected as to reduce to a minimum any danger to persons on board, due regard being paid to moving parts, hot surfaces and other hazards. PSCO Observed temporary repairs on the STBD side MDG discharge piping. 74 SOLAS(97) II-1/26

Electrical installations shall be such that: the safety of passengers, crew and ship from electrical hazards will be ensured. PSCO observed dead end wires on Port Side MDG. 74 SOLAS(04) II-1/40.1

Fire-fighting systems and appliances shall be kept in good working order and readily available for immediate use. PSCO observed approximately half of the vessels' CO2 bottles' activation cable is installed in a manner where the bottle's hoses would hinder the proper activation of the bottles and the vessel's most starboard and forward bottle had a severed activation cable. 74 SOLAS(20) II-2 14.2

In a ship in which oil fuel is used, the arrangements for the storage, distribution and utilization of the fuel shall be such to ensure the safety of the ship. PSCO observed oil accumulation Aft of the main engine port side. 74 SOLAS(97) II-2/15.2

The following fire protection systems shall be kept in good order so as to ensure their required performance if a fire occurs: structural fire protection including fire resisting divisions, and protection of openings and penetrations in these divisions. PSCO observed missing "A" boundary insulation in the engine room over the main engine. 74 SOLAS(20) II-2 14.2

Fire-fighting systems and appliances shall be kept in good working order and readily available for immediate use. Portable extinguishers which have been discharged shall be immediately recharged or replaced with an equivalent unit. PSCO observed a fire extinguisher forward of the vessels' OWS undercharged and several extinguishers throughout the ship have not been inspected by the crew. 74 SOLAS(20) II-2/14.2

The machinery, boilers and other pressure vessels, associated piping systems and fittings shall be of a design and construction adequate for the service for which they are intended and shall be so installed and protected as to reduce to a minimum any danger to persons on board, due regard being paid to moving parts, hot surfaces and other hazards. PSCO Observed excessive corrosion and wastage on overflow tank vent pipe located to the port of the main engine along the room's upper deck. 74 SOLAS(97) II-1/26.1

A Document of Compliance shall be issued to every company which complies with the requirements of the International Safety Management Code. A Safety Management Certificate shall be issued to every ship by the Administration or an organization recognized by the Administration. PSCO observed the Interim Safety Management Certificate and Document of Compliance are expired. 74 SOLAS (20)IX/4 ISM 4

A Cargo Ship Safety Construction Certificate shall be issued for a period specified by the administration. PSCO observed the vessel Cargo Ship Safety Construction Certificate was expired. 74 SOLAS(20) I/14

03111 - Cargo ports and other similar openings in the sides of ships below the freeboard deck shall be fitted with doors so designed as to ensure watertightness and structural integrity commensurate with the surrounding shell plating. Stern ramp door noted to have buckled longitudinal frame (#8 from port side), multiple longitudinal frames with sections completely wasted through (#5, #6 from port side, etc.) and attachment between longitudinal frames and transverse bottom frame severely wasted through at multiple points (#2, #3, #5, #6, #11, #12, #14, #15 from port side, etc.). *Prior to cargo discharge, Flag Administration and/or RO to attest to the suitability of stern ramp for cargo operations, including risk assessment and mitigation plan. 15109 - The safety management system should ensure compliance with mandatory rules and regulations [1.2.3.1]. The Company should ensure that inspections are held at appropriate intervals [10.2.1]. Vessel has a 6 ton freight elevator for moving cargo between the lower and main cargo (ro-ro) decks. This freight elevator is included on the ILO 152 Register of Lifting Gear and requires 5-year weight tests and annual inspections. The last record in the Register of Lifting Gear for an annual inspection is from 2017, and the last record of a 5-year weight test is from 2015. *Required to be rectified prior to use of freight elevator for discharging of cargo from lower hold. 74 SOLAS 20 IX/3.1 REF ISM Code 1.2.3.1 and 10.2.1 17ac

01308 - All person who are assigned duty as officer in charge of a watch or as a rating forming part of a watch and those whose duties involve designated safety, prevention of pollution and security duties shall be provided with a rest period of not less than: [.1] a minimum of 10 hours of rest in any 24-hour period [2.1]. The hours of rest may be divided into no more than two periods, one of which shall be at least 6 hours in length [3]. Administrations shall require that records of daily hours of rest of seafarers be maintained in a standardized format, in the working language or languages of the ship and in English, to allow monitoring and verification of compliance with the provisions of this section [7]. Daily record of hours of rest does not provide objective evidence that minimum 10 hours of rest is divided into not more than two periods. Additionally, the rest hour records available onboard at time of attendance are only in Spanish. STCW A-VIII/2.1, 3, 7 17bc

09134 - The arrangement and equipment of the catering department in every ship shall be such as to permit the service of proper meals to the members of the crew [ILO 147, Food and Catering, #3]. Crew accommodations shall be maintained in a clean and decently habitable condition [ILO 147, Crew Accommodations, #33]. Galley found in unhygenic condition and the Company has not provided the vessel will the necessary equipment to permit the provision of the seafarers with meals prepared and served in safe and hygenic conditions. Specifically, numerous flies were observed flying in the galley and crawling on food. Provided cooking pans and baking tins are heavily soiled and rusted. One sink found inoperable. Galley presently equipped with only one cutting board. Meat slicer does not have requisite guard, resulting in multiple injuries to ship's personnel. Fish freezer is inoperable; provided portable freezers of insufficient capacity and without appropriate temperature monitoring. Meat and vegetable freezers do not properly seal. Freezer locked-in alarm inoperable (has been removed). 46 USC 70002 17c

09130 - Sanitary accommodations shall comply with the following requirements: (c) cold fresh water and hot fresh water available in all wash spaces [ILO 147, Crew Accommodations, #21]. Water in multiple sinks and other sanitary spaces observed to be dark brown in color. 46 USC 70002 17c

09102 - In ships trading regularly to mosquito-infested ports, provision shall be made to protect the crews' quarters against the admission of mosquitos [ILO 147, Crew Accommodations, #32]. Vessel's AC is currently inoperable, causing windows to be opened in order to reduce air temperatures, which were reported to be as high as 37 degrees Celcius during the recent voyage. These windows lack bug screens, resulting in ingress of flies and other bugs into the accommodation space. 46 USC 70002 17c

09111 - Water closet accommodations shall be provided for the exclusive use of the occupants of the hospital accommodation, either as part of the accommodation or in close proximity thereto [ILO 147, Crew Accommodations, #30]. Hospital only has sink and toilet. Shower provided in adjacent room is currently used as storage space and not in proper working condition. 46 USC 70002 17c

09104 - An adequate supply of heating crew accommodation shall be provided [ILO 147, Crew Accommodations, #4]. There is reported to be no heat presently available in the crew accommodation spaces. 46 USC 70002 17c

CG005 - The master, owner, operator, agent or person in charge of a vessel subject to this subpart must submit a ballast water reported to the NBIC no later than 6 hours after arrival at the port or place of destination. Vessel arrived to Baltimore on 10/29/21 and has not submitted a NBIC report as of 11/5/21. 33 CFR 151.2060 17c

13101- The machinery, boilers, and other pressure vessels, associated piping systems and fittings shall be of a design and construction adequate for the service for which they are intended. While shifting from one berth to another, the vessel lost propulsion on its main engine. 74 SOLAS (97) II-1/26.1 60ac

14105- After any survey of the ship has been completed, no change shall be made in the structure, equipment, systems, fittings, arrangements or material covered by the survey, without the sanction of the Administration, except the direct replacement of such equipment and fittings. Sounding tube/level indicator on side of bilge water tank has been replaced with flexible hose. This arrangement also has a t-connection with an additional flexible hose of approximately 17 feet in length that reaches to a bolted opening in the starboard sideshell of the vessel near the bunkering station. 14105- After survey of the ship has been completed, no change shall be made in structure, equipment, systems, fittings, arrangements or material covered by the survey, without the sanction of the Administration, except the direct replacement of such equipment and fittings.Sounding tube on sludge tank is reported to be clogged and unusable. An additional sounding tube has been fitted to the sludge tank hatch. Sludge tank hatch found unbolted and ajar at time of attendance. MARPOL I/6.4.2 17ac

The following fire protection systems shall be kept in good order so as to ensure their required performance if a fire occurs: [.1] structural fire protection, including fire-resisting divisions, and protection of openings and penetrations in these divisions. Ventilation ducting for engine room found holed in multiple locations where it passes through the enclosed ro-ro cargo deck space. This would allow transmission of a fire from the engine room to the cargo deck and vice versa. 74 SOLAS (20) II-2/14.2.1.1.1 17ac

07126- In a ship in which oil fuel is used, the arrangements for the storage, distribution and utilization of the oil fuel shall be such as to ensure the safety of the ship and persons on board. Approximately 2 feet of standing oily water/oily residue found in aft bilge well. This poses a significant fire hazard in the engine room. 74SOLAS(97) II-2/15.2.1 17ac

01315 - Each operation shall be fully recorded without delay in the Oil Record Book (ORB) Part 1. The ORB is missing numerous entries, including transfers from the bilge to the bilge holding tank and transfers from the sludge tank. Additionally, there are multiple entries in the ORB for discharge overboard of bilge water via the OWS during periods of time where the OCM data log/history indicates that the OWS was not operating. 14101 - The capacity of the supply pump should not exceed 110% of the 15 ppm Bilge Separator. The maximum throughput for the Bilge Separator is 0.7m3. Multiple entries in the Oil Record Book showed the throughput exceeding 0.7m3. For example, on 10/20/21, the logged throughput was 3.5m3 from 12:50 to 15:40. MARPOL I/14.7 MEPC.107(49) 6.1.2 30ac

06101 - Cargo, cargo units and cargo transport units shall be loaded, stowed and secured throughout the voyage in accordance with the Cargo Securing Manual approved by the Administration. The vessel does not have a cargo securing manual. 74SOLAS(20) VII/5 30ac

17105 - The following fire protection systems shall be kept in good order: fire protection, including fire resisting divisions, and protection of openings and penetrations in those divisions. Multiple "A" class fire screen doors were not fully closing and latching or sealing, including the main stairwell door on the main deck, the door to the engine casing on the main deck, the door from the accommodations to the aft mooring deck, and the door from the engine room to the cargo deck. 74SOLAS(20) II-2/14.2.1.1.1 30ac

02105 - The condition of the ship and its equipment shall be maintained to conform with the provisions of the present regulations. Water is leaking into the steering gear room through the packing glands on the steering gear. The Chief Engineer stated the packing glands were tightened but continue to leak. 74SOLAS(20) I/11(a) 30ac

14109 - Any discharge into the sea of oil or oily mixtures from ships of 400 gross tonnage and above shall be prohibited except when all the following conditions are satisfied: the oil content of the effluent without dilution does not exceed 15 ppm. PSCO observed oily water discharge going into a bucket after the three way valve. That oily water discharge was over 15 ppm even though the oil content meter was reading less than 15 ppm. 14104 - Oil filtering equipment referred to in paragraph 1 of this regulation shall be of a design approved by the Administration... The oil filtering equipment had an unapproved modification. A valve was added downstream of the oil content meter and three-way valve arrangement which was not on the approved plans. MARPOL I/14.6 30ac

02108 - The electrical power available shall be sufficient to supply all those services that are essential for safety in an emergency. The emergency generator panel shows it runs on 380V and 50Hz. When tested, the panel did not show any voltage output. 74SOLAS(04) II-1/43.2 17ac

07126 - In a ship in which oil fuel is used, the arrangements for the storage, distribution and utilization of the oil fuel shall be such to ensure the safety of the ship. PSCO observed oil leaks on the main engine, generator, the valve on the main engine service fuel oil tanks, and fuel oil pumps. Additionally, there was oil pooled under the generator, the main engine, and the shaft to the aft part of the engine room. 74SOLAS(97) II-2/15.2.1 17ac

01108 - Certificate shall not be delivered to the ship until the officer or surveyor has certified that the marks are correctly and permanently indicated on the ship's sides. The Load Line Marks did not match what was on the issued Load Line Certificate. ILLC (66) 9 17ac

13199 - The machinery, associated pipings and fittings shall be adequate for the service for which they are intended. The exhaust for the emergency generator was leaking into the space from the exhaust connection manifold. 74SOLAS(04) II-1/26.1 17ac

02108 - The front of switchboards shall be suitably guarded. The switchboard for the emergency generator had 3 openings in the front. 74SOLAS(04) II-1/45.2 17ac

11118 - Each lifejacket light shall be visible when attached to a lifejacket. Lifejackets at the forward liferaft station were missing lights. 74SOLAS(97) III/32.3 17ac

11118 - Each lifejacket shall be fitted with a whistle firmly secured by a cord. Lifejackets in the engine control room were missing whistles. 74SOLAS(97) III/32.1.6 17ac

11117 - Life buoys shall be so distributed as to be readily available. The lights for the lighted life buoys were hanging over the railings and not properly secured, making it easy for the lanyards to get entangled. 74SOLAS(97) III/7.1.1.1 17ac

09205 - Means shall be provided to ensure safe passage for any person embarking on or disembarking from the ship. The port side accommodation ladder had a cracked bottom platform without a connection point to the pin. The bottom of the starboard accommodation ladder was stuck at an angle and was unable to be properly secured by pins. 74SOLAS(20) V/23.4 17ac

09208 - The machinery, boilers and other pressure vessels, associated piping systems and fittings shall be of a design and construction adequate for the service for which they are intended and shall be so installed and protected as to reduce to a minimum any danger to persons on board, due regard being paid to moving parts, hot surfaces and other hazards. Insulation was missing on the turbo charger for the main engine. 74SOLAS(04) II-1/26.1 17ac

09209 - Electrical installations shall be such that: the safety of passengers, crew, and ship from electrical hazards will be ensured. Multiple light covers were damaged throughout the ship to include cargo decks and the engine room. 74SOLAS(04) II-1/40.1.3 17ac

03106 - All access openings in bulkheads at ends of enclosed super structures shall be fitted with doors of steel or other equivalent material, permanently and strongly attached to the bulkhead and framed, stiffened, and fitted so as to be weathertight when closed. The weathertight door on the main deck port side going into the superstructure was wasted and did not create a weathertight seal. ILLC (66) 12.1 17ac

01314 - Every ship other than an oil tanker of 400 gross tonnage and above shall carry on board a shipboard oil pollution emergency plan approved by the administration. Vessel was missing numerous items from their SOPEP locker that were listed in their plan. MARPOL I/37.1 17ac

99103 - A ship of 300 gross tons or more must have a fixed container or enclosed deck area under or around each fuel oil or bulk lubricating oil tank vent, overflow, and fill pipe. One of the main deck starboard side fuel vents had a wasted containment and was unable to properly contain oil. 33 CFR 155.320(a) 17c

01123 - For ships constructed before 1 July 2004, the continuous synopsis record shall, at least, provide the history of the ship as from 1 July 2004. PSCO observed missing CSR documentation. Vessel only had the 2 most recent CSR's on board. 74SOLAS(20) XI-1/5.2.2 17ac

15105 - The company should establish procedures to ensure that the ship is maintained in conformity with the provisions of the relevant rules and regulations and with any additional requirements which may be established by the company [10.1]. The Company should establish procedures, plans and checklists for key shipboard operations [7]. The Company should identify potential emergency shipboard situations and establish procedures to respond to them. The vessel was unable to provide procedures and/or checklists for key shipboard operations including use of the emergency generator, oily water separator, cargo securing, and bunkering. Many of the below-listed technical and/or operational deficiencies provide objective evidence that the maintenance program as presently implemented onboard does not effectively ensure that the vessel is being maintained in substantial compliance with the relevant conventions. The crew was also initially unable to complete a successful fire drill and the SMS lacked procedures for conducting fire drills. The Captain of the Port questions the adequacy and overall implementation of the vessel's SMS under the ISM Code. An external audit conducted by the Flag or RO is required to determine the vessel's compliance with the ISM Code prior to departure from port. 74 SOLAS (20)IX/3.1 ISM 7, 8.1, and 10.1 30ac

15106 - An interim Safety Management Certificate may be issued following verification that: the safety management system provided by the company for the ship concerned includes key elements of this Code and has been assessed during the audit for issuance of the Document of Compliance or demonstrated for the issuance of the Document of Compliance. The vessel does not have established procedures for routine shipboard operations such as operating the oily water separator or testing the emergency generator. The Chief Engineer was not provided, or did not have access to checklists for machinery related maintenance. Additionally, the Chief Engineer is in the process of writing engine room SMS procedures on board the vessel. 99101 - When operating a vessel on a body of water where the discharge of treated or untreated sewage is prohibited by the Environmental Protection Agency under 40 CFR 140.3 or 140.4, the operator must secure each Type I or Type II device in a manner which prevents discharge of untreated sewage. The vessel exceeded the capacity of the sewage tank and sewage was raining down over the turbocharger and down into the bilge of the engine room. 33 CFR 159.7(b) 17c
