To discharge ballast water into waters of the United States, the master, owner, operator, agent, or person in charge of a vessel subject to 151.2025 of this subpart must either ensure that the ballast water meets the ballast water discharge standard as defined in 151.2030(a), use an AMS as described in 151.2025(a)(3) or ballast exclusively with water from a U.S. public water system, as described in § 151.2025(a)(2), according to the schedule in paragraph (b) of this section. Subject vessel, of keel laid date 17JUN2020 and ballast water capacity of 21,886 m3 is past its compliance date per the implementation schedule in 33 CFR 151.2035(b). Currently,vessel's installed BTWS is inoperative. Vessel is not authorized to discharge untreated ballast into waters of the U.S. without prior written authorizetion from the local Captain of the Port under the provisions of 33 CFR 151.2040(b). 33 CFR 151.2035

Oil tankers of 20,000 tonnes deadweight and above, constructed on or after 1 January 2012, shall be provided with a fixed hydrocarbon gas detection system complying with the Fire Safety Systems Code for measuring hydrocarbon gas concentrations in all ballast tanks and void spaces of double-hull and double-bottom spaces adjacent to the cartgo tanks, including the forepeak tank and any other tanks and spaces under the bulkhead deck adjacent to cargo tanks. Vessel gas samplying system inoperable. Vessel is prohibited from carriage of hydrocarbon containing cargoes in the United States until corrected. SOLAS CONS. 2020/II-2 Reg 4.5.7.3.1
